๐จCASE UPDATE: The Constitutional Court just ruled that the Western Cape government and the City of Cape Townโs sale of the Tafelberg site in Sea Point has been declared unlawful.
Here's the background if you're new to this story. For a decade, campaigners have been fighting over what should happen to well-located, high-value land in Cape Town. The debate centres on whether the site should go to the highest bidder or whether some of it should be used for affordable housing close to jobs, schools and transport.
The apex court found that both the province and the city failed to provide adequate housing and equal access to land in well-located parts of the city. The judgment specifically flagged that pushing affordable housing out to cheaper land on the urban edge doesn't fix apartheid spatial patterns; it just keeps them going.
The Western Cape government now has to report back to the court on what it's actually doing to meet its housing obligations.
