Ramsamy: The letter to Kumalo was NEVER sent—Johnson told her to shred it. She then wrote to Senthumule instead. Johnson testified they sent it to Kumalo and he said dockets weren't with him—but that's false. IDAC usually requests certified copies, not originals. Ramsamy questioned why they took originals.

[WATCH] Madlanga: “Why was Commissioner Masemola lumped with these people, charged with fraud and corruption, when he is not?... This must have been done to taint and embarrass him.”
Johnson: “I accept that [in] this matter... he should be separated." #MadlangaCommission

Commissioner Khumalo:
‘Good morning Advocate Johnson, I’ll start with the process leading to the charges against General Masemola.’
Refers to the PFMA, it requires wilful and gross negligence.
We know that #GeneralMasemola acceded to the advice from Risk.
How is it that he is charged under the PFMA?
Where is wilful and gross negligent conduct?
You can only sustain the charges if he ignored the advice’
Adv Johnson:
‘From the time he was informed, Masemola took time before he acted.
Because he took time before terminating and monies were released.
Khumalo:
‘You accept that it is not wrong to apply one’s mind. You could be sued for breach each.
We also took issue with you for applying your mind etc, ask questions, etc.
Charge sheet creates impression that loss to saps happened after advice given.
Adv Johnson:
‘I accept that General Masemola accepted and acted on the advice’
DEVELOPING:
SAPU CALLS FOR HEADS TO ROLL AT IDAC
The South African Policing Union (SAPU) welcomes the withdrawal of charges
against Lt. Gen. Dumisani Khumalo and his co-accused.
This development vindicates the concerns SAPU raised from the outset about the premature arrests
and the manner in which the investigation was handled.
It is now clear that the investigation was incomplete, yet our members were arrested, humiliated and their integrity publicly questioned.
SAPU asks a simple question – Who will account for the damage caused?
Law enforcement agencies cannot be allowed to abuse their powers without
consequence. Arresting people before completing proper investigations is not
justice – it undermines justice and damages public confidence in our criminal justice system.
SAPU therefore calls for heads to roll at IDAC. Those responsible for reckless,
premature or procedurally improper decisions must be held accountable.
We support the fight against corruption, but the fight against corruption must never become an excuse for the abuse of state power.
SAPU will continue to defend the dignity, integrity and rights of its members.
