▪️In Achal Singhal v. State of Karnataka & Anr., Karnataka HC, while granting bail to a man charged u/s 69 BNS (rape on the false promise of marriage), who had spent 42 days in jail, flagged the growing misuse of the provision in cases arising out of failed relationships.
▪️Court observed, “Though Section 69 BNS would punish a person for having sexual intercourse with the victim on a deceitful promise of marriage, in the case at hand there is no indication except that the alleged breach of promise of marriage appears to be an afterthought that has surfaced in the complaint.”
▪️As per the facts placed before the Court, the complainant and the accused were colleagues whose friendship gradually developed into a consensual romantic relationship. The relationship lasted for around 8 months and involved physical intimacy, but eventually ended, following which the woman filed a complaint.
▪️She alleged that the accused had engaged in sexual intercourse with her on the false promise of marriage. Based on this allegation, an FIR was lodged, leading to the arrest and continued custody of the accused for over a month.
▪️Upon perusal of the complaint, Court noted that there were no allegations of force, coercion, or absence of consent. Instead, the relationship appeared to be entirely consensual, and the grievance arose only after the relationship had broken down.
▪️Court took serious note of the “mushrooming number” of such cases and observed a pattern where criminal proceedings are initiated after breakups, thereby invoking Section 69 BNS as a tool of retaliation rather than addressing genuine cases of deceit.
▪️Relying on multiple precedents, Court held that the continuation of criminal proceedings in such circumstances would be contrary to settled legal principles governing consent and false promise cases.
▪️Accordingly, Karnataka High Court allowed the applications filed by the accused, granted him bail, and stayed further proceedings pending before the Magistrate.
▪️Court also highlighted the need to prevent misuse of Section 69 BNS in cases of consensual relationships that later turn sour.

Monalisa Bhosle, the bead seller who became an overnight internet sensation in Prayagraj during Maha Kumbh Mela, has been found to be a minor, leading to an FIR against her husband Farman Khan under the Protection of Children from Sexual Offences (POCSO) Act in Madhya Pradesh.
Monalisa Bhosle married her partner of nearly six months, Farman Khan, at a temple in Poovar last month.
As per reports, the National Commission for Scheduled Tribes (NCST) launched an investigation that stretched across Kerala and Madhya Pradesh.
The probe has found that Monalisa belongs to the Pardhi tribal community and is legally a minor.
According to hospital records from Maheshwar, her date of birth is December 30, 2009.
Investigators found that the marriage took place in Kerala using forged documents. A fake birth certificate was allegedly created to show Monalisa as an adult.
The marriage was also registered at a gram panchayat office in Kerala using these documents. Temple authorities reportedly relied on Aadhaar details provided by the couple at the time of the ceremony.
Based on the findings, police registered an FIR against Farman Khan at Maheshwar police station in Khargone district of Madhya Pradesh.
Apart from the POCSO Act, charges have also been filed under provisions of the Bharatiya Nyaya Sanhita (BNS) and the SC/ST (Prevention of Atrocities) Act, considering Monalisa’s tribal identity.
However, it is noteworthy that Monalisa gave various interviews after her marriage claiming she married on her own Will and is happy.

A bride in #Agra (Jagdishpura) demanded ₹90 lakhs from the groom on her wedding night, saying that she would not have any physical relations unless he paid her the money.
When the groom refused, a heated argument broke out.
Family members from the groom’s side reportedly tried to counsel the bride, but the situation worsened after she informed her own family.
Bride's family then surprisingly created a ruckus instead of solving the matter and vandalised the groom's house & and even damaged a PNG gas pipeline.
The bride later fled from the scene, reportedly taking along both her own belongings and jewellery belonging to her mother-in-law.
The victim’s family also alleged that they initially approached the local police, but no action was taken.
Then they moved the court, after which a case was registered at Jagdishpura police station against the bride, her father and other associates.
the in-laws further claimed that the bride confessed she was not interested in the marriage and had agreed to it solely for financial gain.
