I have spent the better part of my life in uniform defending this Republic and the values upon which it was founded. I did not carry arms so that clever men in suits could later use the law as a weapon against the very people the law was written to protect. And so, with the authority of one who has seen what happens when institutions lose their moral spine, I address the Attorney General of Zimbabwe directly and I do so without apology. Attorney General, step back from the politics. Do your job.

I. Cabinet Cannot Initiate a Constitutional Bill Full Stop
I have read your public pronouncements. I have watched you perform constitutional acrobatics that would embarrass a first-year law student. Let us begin with a simple question: did you read Section 110(3)(c) before advising Cabinet to initiate a constitutional bill?
Section 110(3)(c) grants Cabinet the power to initiate national legislation. But Section 332 of our Constitution is unambiguous national legislation means an Act of Parliament or a statutory instrument made under an Act of Parliament. A constitutional bill is defined separately, in the same provision, as a bill whose enactment would amend this Constitution.

These are two distinct categories. They are not interchangeable. Cabinet has authority over one. It has no authority over the other.
Section 130(1) grants the National Assembly the power to initiate any legislation deliberately broad language that acknowledges the plurality of legislative categories. Cabinet's role is confined to bills that terminate as Acts of Parliament or statutory instruments. A constitutional amendment is not in that lane. Cabinet wandered out of its lane, and you said nothing.
A government cannot amend a people's expression without their authority. That is not constitutional theory that is elementary democratic principle.

More than that, Section 196(1) imposes a solemn duty on all public officers authority is a public trust, to be exercised consistently with the purposes of this Constitution, in a manner that demonstrates respect for the people. When an executive arm reaches beyond its delegated authority to stretch the very peripherals of that authority, it does not simply make an error. It betrays the public trust. Attorney General, you were present in that cabinet room. Your silence made you complicit.

II. Regular Elections Are Not a Policy Preference They Are an Individual Right. You correctly noted in your own public statement that Sections 158, 143, and 95 collectively regulate the periodic cycle of elections. You were right. But then you stopped thinking and that is where you failed Zimbabwe.

The right to regular elections is not a procedural technicality buried in electoral law. It is an individual human right. Article 21 of the Universal Declaration of Human Rights, Article 25 of the International Covenant on Civil and Political Rights, Article 17 of the African Union Charter on Democracy, Elections and Governance, and Article 4.1 of the SADC Principles and Guidelines Governing Democratic Elections all protect every citizen's right to periodic elections without distinction of any kind.

Our own Constitution is equally explicit. Section 3(2)(b)(ii) binds every institution of the Republic to the principle of regular elections as a founding value. Section 67(1)(a) enshrines in every Zimbabwean citizen a justiciable right to regular elections. Section 44 places an affirmative duty on the State to respect, protect, promote, and fulfil that right. Section 45(1) makes this binding on all arms of state. And Section 46(1)(a) the interpretive provision compels every reading of every other constitutional provision to give full effect to the rights in Chapter 4.
