No, this is not what "the law intended" because H1B visas are written into law as 'dual intent', you can explicitly work in the U.S. temporarily while pursuing permanent status.

This is the Immigration and Nationality Act §214(b) and (h), codified at 8 U.S.C §1184(b) and (h), which is why the Dept. of State Foreign Affairs Manual says "H-1B nonimmigrants … are accorded dual intent” the law expressly allows H1B holders to pursue a green card while working temporarily in the U.S.

🚨 Human Stories and the Impact of USCIS PM-602-0192/94. (1).

A board-certified Internal Medicine physician in the Northeast, with 5+ years of U.S. medical experience and completed U.S. residency training, reports that she has been on indefinite leave for 3 months after her H-1B status expired, despite filing a timely renewal, while her I-485 EAD has remained pending for 8 months.

Why is it stuck?
Because she was born in one of the 39 travel-ban/pause policy countries. The policy applies regardless of merit, individual history or length of legal stay.

This physician served an underserved/rural community where patients already faced long wait times. Her clinic schedule had to be disrupted and appointments rescheduled to other physicians on short notice. ~1200 patients lost access to their doctor overnight.

She is also pregnant. She lost her employment sponsored health insurance mid pregnancy. She cannot work, cannot earn a living.

Her words:

“It is really frustrating and heartbreaking after this many years that we still have to deal with this.”

This is not a harmless processing delay.

It is forcing trained physicians out of hospitals and clinics, harming patients, destabilizing families, and punishing people who followed the law.
