चंदन गुप्ता हत्या केस को लेकर NIA कोर्ट के स्पेशल जज विवेकानंद शरण त्रिपाठी का फैसला

3 जनवरी, 2025 को, NIA कोर्ट के स्पेशल जज विवेकानंद शरण त्रिपाठी (वी.एस. त्रिपाठी) ने 26 जनवरी, 2018 को कासगंज के अभिषेक उर्फ चंदन गुप्ता की क्रूर हत्या में मुस्लिम समुदाय के 28 आरोपियों को दोषी ठहराया और उन्हें आजीवन कारावास की सजा सुनाई।
यह भयावह हत्या चंदन की तिरंगा यात्रा के दौरान मुस्लिम समुदाय के लोगों ने की थी।
आजीवन कारावास की सजा के अलावा, जज त्रिपाठी ने अपने फैसले में एक और महत्वपूर्ण मुद्दा उठाया है और वह है पैसे के लिए किसी का भी प्रतिनिधित्व करने के लिए महंगे वकीलों की तैयारी!
आज तक सुप्रीम कोर्ट या हाईकोर्ट के किसी भी जज द्वारा इस मुद्दे पर कभी टिप्पणी नहीं की गई है।
सजा सुनाते हुए, जज त्रिपाठी ने अपराधियों को बचाने में शामिल राष्ट्रीय और विदेशी NGO की भूमिका पर सवाल उठाए और उन्हें रोकने के लिए अपने आदेश की एक कॉपी केंद्रीय गृह मंत्रालय और बार काउंसिल ऑफ इंडिया को भेजी है।
जज त्रिपाठी ने अपने आदेश में कहा था कि, “इन एनजीओ को कहां और कौन फंडिंग कर रहा है, उनका अंतिम उद्देश्य क्या है, इसकी पूरी जांच करने की जरूरत है।
ऐसा आरोप है कि जब भी कोई आतंकवादी पकड़ा जाता है, तो ऐसे एनजीओ तुरंत उसका बचाव करने के लिए बहुत महंगे वकील उपलब्ध कराते हैं।
यह राष्ट्रीय सुरक्षा चिंता का विषय है।”
कोर्ट ने अपने आदेश में निम्नलिखित 7 एनजीओ/संगठनों के नाम दिए हैं।

3. रिहाई मंच
4. अलायंस फॉर जस्टिस एंड अकाउंटेबिलिटी, न्यू यॉर्क
5. इंडियन अमेरिकन मुस्लिम काउंसिल, वॉशिंगटन डीसी
6. साउथ एशिया सॉलिडेरिटी ग्रुप, लंदन
7. जमीयत उलेमा हिंद
जस्टिस त्रिपाठी का यह आदेश वास्तव में ऐतिहासिक है और उन्होंने सरकार से समान मांग की है। हाईकोर्ट और सुप्रीम कोर्ट में प्रैक्टिस करने वाले वकीलों की फीस सार्वजनिक रूप से उपलब्ध होनी चाहिए और उनकी संपत्ति की घोषणा भी सार्वजनिक जानकारी के लिए प्रकाशित करनी चाहिए।
उन्होंने हर साल कितना आयकर चुकाया है, यह भी सार्वजनिक करना चाहिए; वकीलों की फीस केवल चेक/बैंकिंग चैनलों के माध्यम से ही वसूली जानी चाहिए; सुप्रीम कोर्ट के शीर्ष वकीलों से वकील फीस की प्राप्ति के बारे में शपथपत्र मांगने चाहिए कि उनकी फीस किसने चुकाई थी, ताकि यह स्पष्ट हो सके कि किसी आतंकवादी संगठन को फंडिंग की गई थी या नहीं।
जज त्रिपाठी के इस ऐतिहासिक आदेश का सभी देशभक्त भारतीयों द्वारा स्वागत और समर्थन किया जाना चाहिए!
रोहिंग्या बांग्लादेशी घुसपैठियों को देश से निकालने की मांग करने वाली एडवोकेट अश्विनी उपाध्याय की याचिका 2017 से लंबित है।
दो रोहिंग्या, मोहम्मद सलीमुल्लाह और मोहम्मद शाकिर, जो भिखारी जैसे दिखते थे और खराब हालत में रहते थे, उनके लिए छह उच्च स्तर के वकील सुप्रीम कोर्ट में पेश हुए।
ये वकील थे - डॉ. राजीव धवन, प्रशांत भूषण, डॉ. अश्विनी कुमार, कॉलिन गोंसाल्विस, फली एस. नरीमन और कपिल सिब्बल।
जबरन धर्मांतरण रोकने के लिए एडवोकेट अश्विनी उपाध्याय की याचिका का 10 महंगे शीर्ष वकील विरोध कर रहे हैं।
पूजा स्थल कानून को चुनौती देने वाली उपाध्याय की याचिका का 22 शीर्ष वकील विरोध करते हुए देखे गए हैं। इनमें सांसद, विधायक और पूर्व कानून मंत्री, गृह मंत्री, विदेश मंत्री और शिक्षा मंत्री भी शामिल हैं।
ऐसे शीर्ष वकीलों के कारण यह याचिका लंबे समय से लंबित है।
सिर्फ अक्टूबर 2024 में, एक अन्य NGO - सोशल ज्यूरिस्ट ने दिल्ली हाईकोर्ट में याचिका दाखिल की और केंद्र से "रोहिंग्या शरणार्थियों के बच्चों को" सरकारी स्कूलों में प्रवेश देने की अनुमति मांगी।
जब हाईकोर्ट ने याचिका खारिज कर दी कि रोहिंग्या विदेशी हैं और उनके पास देश में प्रवेश की कानूनी अनुमति नहीं है और वे देश की सुरक्षा के लिए खतरा हैं, तब यह NGO सुप्रीम कोर्ट पहुंचा और SC ने कहा कि रोहिंग्याओं के बच्चों को शिक्षा दी जाएगी।
ऐसे कई वकील और NGO हैं, उन सभी के फंड की जांच होनी चाहिए।
ताकि हमारी निरंकुश और असंवेदनशील न्यायपालिका भी जवाबदेह बन सके ।
