FACT CHECK🚨 :Ruto has today told the whole country while at State House the government is finally taking the FULL load of higher education off parents’ backs.

I can confirm all that is MISLEADING & i am attaching evidence from the bill. His video in replies too.

Every single line he dropped… and the brutal truth sitting right next to it:

LIE: “The earlier model made it the responsibility of the parent… Now we are placing that responsibility on government.”

FACT: Clause 30(i) still creates a savings scheme so parents can keep depositing money for their child’s university.

If the state is really carrying the full load, why is a parental savings plan written into the law?

Also under Uhuru Kenyatta govt catered for a certain percentage. In the bill govt will cater for zero %

LIE: “The government must make sure a student going to do medicine or engineering does not change course because their parent cannot afford…”

FACT: Right now, the government actually pays a real percentage as scholarships (non-repayable).

Under the new Bill, Clauses 48 & 49 turn almost everything into pure student LOANS.

Government pays ZERO as a gift.

You repay every shilling of the principal + interest + charges.

The state is just the bank. The student is the full debtor.

LIE: “Learning should not be pegged on the ability of the parent. It should be on the ability of the student.”

FACT: Clauses 50 & 51 say repayment starts within 1 year of finishing.

Employers MUST deduct up to 25% of your salary.

Late remittance = 5% monthly penalty.

Unpaid balance = recovered as civil debt like any other court judgment.

They are selling us “government responsibility.”

The Bill delivers:

Parental savings + 100% student debt + automatic 25% salary deductions.

This is not free education.

This is the state stopping the scholarship share it currently pays and replacing it with full loans it will collect from your future salary.

Recent polling shows Edwin Sifuna gaining ground, particularly among younger voters, while Kalonzo Musyoka’s support appears more established but less dynamic. Declaring that only Sifuna can win would be premature, but handing out the ticket as a retirement gift would be an even greater mistake.

Wueh… I just sat down and read this Tertiary Education Bill 2026 from top to bottom, and it'snot what was mostly sold.🚨

Ruto stood on that podium and looked us dead in the eye, promising every child full funding for university.(free university)

“Background will not matter,” he said. “Every qualified student will get full support.”

Kenyans clapped. Parents sighed in relief. Students celebrated.

Then you open the actual Bill…

Clause 44 says the whole Fund is mainly for loans which we can say ok.

Clause 49(1) forces you to start paying principal + interest within one year of finishing.

Clause 49(4) allows them to take up to 25% of your salary. If you add other deductions like nssf etc you are finished.

Clause 30(d) lets them set any interest rate they want - no limit. And this is bad. It means the CS can increase interest rates to any amount.

Clause 60 makes the debt last forever. They can chase your grandchildren. They intend to remove something important using this clause

Clause 30(k) gives them power to walk into private companies and inspect like police. They are to have Quasi police type of powers

This is not free education. This is HELB on steroids, with sharper teeth.

TEFA is just HELB rebranded (Clauses 64–67).

They sold us a dream and wrote a debt sentence.

Where exactly in this Bill is education free? Show me the clause. I’m waiting. Also its not a guarantee all students will even qualify.

From 14 August 2026, Kenya’s Communications Authority wants cyber cafés to identify their customers, link them to the specific computer they use, record when they log in and out, and retain those records for at least THREE YEARS.

This is not a small administrative rule. It raises a serious constitutional question: when did accessing the internet become an activity for which every innocent Kenyan must leave an identity trail for the State?

Article 31 of the Constitution guarantees the right to privacy, including the right not to have private information “unnecessarily required or revealed” and the right not to have the privacy of our communications infringed.

Then there is Article 24. Government cannot simply limit a constitutional right because it has identified a legitimate problem such as cybercrime. A limitation must be grounded in law, reasonable, proportionate and justifiable — and the State must consider whether there are less restrictive means of achieving the same objective.

That is the real question here.

Why must millions of perfectly innocent Kenyans surrender their names and ID numbers simply because they walked into a cyber café?

Why must their identity be linked to a particular computer and a particular time?

Why should that information sit in thousands of small private businesses for THREE YEARS, creating another enormous pool of personal data vulnerable to theft, abuse, profiling or unauthorised access?

Kenya's Data Protection Act also requires data minimisation: collect only what is necessary for a legitimate purpose. Section 39 further says personal information should only be retained for as long as reasonably necessary, subject to the statutory exceptions.

Fight cybercrime. Investigate fraudsters. Get court orders. Preserve evidence. Trace suspects.

But do not turn every citizen into a potential suspect and every cyber café into a miniature surveillance registry.

The Constitution was deliberately written to restrain the State precisely when the State says: “Trust us, this is for your security.”

Security matters.

But so does liberty.

And under Articles 24 and 31 of the Constitution and the Data Protection Act, 2019, the Government still has to prove that this blanket collection and three-year retention of innocent citizens’ identity data is necessary, proportionate and the least restrictive way of fighting cybercrime.

Until that threshold is demonstrated, these licence conditions deserve an urgent constitutional challenge.
