🚨Gov. Bob Ferguson and Attorney General Nick Brown joint press conference today at the state Capitol discussing an ICE memo directing agents to use force to enter homes with an administrative I-205 warrant and not a judicial warrant. The administrative warrant is being used to arrest someone with a final order of removal.

Form I-205 "Warrant of Removal/Deportation" or Form I-200 "Warrant for Arrest of Alien" are based on administrative probable cause that a noncitizen is removable, often supported by a final order of removal, prior proceedings, or evidence of unlawful presence/status violations. These authorize the arrest and detention of the named individual for civil immigration enforcement (removal proceedings/deportation), not criminal prosecution. They explicitly do not authorize searches of premises or persons beyond what is incident to a lawful arrest.

No U.S. Supreme Court case has directly upheld forced, non-consensual entry into a private home using only an administrative (non-judicial) warrant in immigration enforcement. Lower courts and experts generally conclude admin warrants suffice for arrest authority but not for overriding the home's threshold without judicial oversight.

Gov Ferguson: Met with General Welsh on activating the National Guard to help protect Washingtonians from the federal government.

Nick Brown: ICE is violating the 4th Amendment. Judges need to sign off on warrants that require entry into a home. My staff is monitoring the situation closely and speak with colleagues in MN daily. When we can, we do move quickly when Washingtonian rights are violated.
