Re: Parking Charge Notice [PCN NUMBER]Vehicle Registration: [REGISTRATION]
I write in my capacity as the registered keeper of the above vehicle to formally challenge this Parking Charge Notice.
The notice alleges "Non Payment" at Almondvale West Retail Park, Livingston on 21 May 2026.
Your ANPR records indicate that the vehicle entered the site at 17:46 and exited at 17:56, a total duration of approximately ten minutes.
The British Parking Association Code of Practice requires operators to allow motorists a reasonable consideration period in which to enter a site, locate a parking space, review and understand the signage and contractual terms, and decide whether to remain or depart.
A presence on site of only ten minutes is entirely consistent with a driver entering the location, considering the displayed terms and conditions, electing not to remain, and then leaving. In those circumstances, no parking contract is formed or accepted, and no parking charge can lawfully arise.
Your ANPR system records only entry and exit times. It does not establish that the vehicle was parked, that any parking bay was occupied for a material period, or that the driver accepted any contractual terms. I therefore require strict proof that the vehicle was parked in breach of clearly stated terms and conditions, rather than merely entering the site, considering the terms, and departing.
Further, the alleged event occurred in Scotland. The keeper liability provisions contained in Schedule 4 of the Protection of Freedoms Act 2012 have no application in Scotland. As the registered keeper, I am under no legal obligation to identify the driver, and I decline to do so.
Accordingly, in the absence of evidence establishing the identity of the driver, together with evidence that a legally enforceable parking contract was formed and subsequently breached, there is no lawful basis upon which you may pursue me as the registered keeper. Any assertion of keeper liability would be misconceived and unsupported by the applicable legal framework in Scotland.
In light of the above, I require that this Parking Charge Notice be cancelled forthwith.
Should you reject this appeal, please provide:
A copy of all photographs relied upon.
Evidence of the period during which the vehicle was actually parked.
A copy of the signage in force on the date concerned.
A site plan showing the location of all signage.
Evidence of your authority from the landowner to issue and pursue parking charges at this location.
