Here is the unsealed (public) ICC warrant against Bato Dela Rosa. It considers the same crime as Duterte, crimes against humanity in the acts of murder. But in his case, ICC prosecutor will pin him down for the death of 32 persons between July 3, 2016 until end of April 2018.

Constitutional Immunity vs. Privilege

The Constitution provides a privilege from arrest, not absolute immunity.

Article VI, Section 11 states: "A Senator or Member of the House of Representatives shall, in all offenses punishable by not more than six years imprisonment, be privileged from arrest while the Congress is in session".

Limitation: If the offense carries a penalty of more than six years—such as the serious crimes against humanity alleged in some reports—this constitutional privilege does not apply.
