But even a guy whoโs skimmed the Constitution once knows judicial review is part of the basic structure. No โdealโ with the executive can oust that. Full stop.
The Supreme Court has every authority to pass any order in proceedings before, especially when fundamental rights are allegedly violated. Injured police officials are also citizens of India. They too have a right to justice.

And why the sudden concern for history-sheeters? Genuine protestors should be superbly relieved by todayโs interim order. Court has told the state: donโt proceed against the protesting crowd. Only those with criminal antecedents face action. Times of India reports police have already identified over 100 history-sheeters, including murder accused, who were part of the crowd.
Are you worried about them? Or is the real fear that continued facial recognition might also flag a few Naxals who decided to join the โpeacefulโ party?

In light of the recent public statements and administrative commitments concerning the blanket withdrawal or quashing of First Information Reports (FIRs) related to the agitations led by the CJP and associated acts of public disorder, our Clients wish to assert their legal rights and standing. They vigorously oppose any such executive concessions or applications filed pursuant to Section 360 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (formerly known as Section 321 of the CrPC).
It is well-established in law that the withdrawal of criminal prosecution cannot be permitted as a mere political compromise or executive leniency in cases involving cognizable offenses such as public violence, obstruction of public servants in the line of duty, and disturbance of public peace. Consequently, our Clients will be submitting appropriate Intervention Applications and Impleadment Petitions to the competent jurisdictional Courts. They aim to demonstrate that any unilateral withdrawal of prosecution threatens the rule of law, and the dismissal of such criminal proceedings without judicial review would be entirely illegitimate, legally unsound, and against the public interest.

๐Last word on this today. Just compiling a list of videos from Jantar Mantar and a few other states in the Northern parts of India where CJP or CJP-like NEET-related protestors go after the CRPF or the Police force in the most brutal way and also destroy public property and steal from food riders.
For every action, there will be an equal and opposite reaction and I can see and been told that the security forces were provoked on numerous occasions with abusive calls and whatnot. I'm still proud of the restraint shown because the protestors didn't have the basic maturity and intelligence to differentiate between security forces and politicians that rule them.
These are the people that are being pardoned without any cases whatsoever.
No mature democracy will agree to this. India ain't a mature democracy.

BJP agreed to take back the FIRs filed against the rioters. Now good luck for future, theyโll come back at another time with bigger violence because now they know that none of their act of violence will have any consequence. The criminals will roam free because now thereโs no fear of law or any action against their crime. Accepting this demand is worse than accepting Pradhanโs resignation.
