A financial year is not a natural year; it is a statutorily defined accounting period. When we say 28 December 2025 and 7 January 2026 fall in the same financial year, we are not referring to the calendar year. We are referring to a legal period expressly created by statute.

The same principle applies here. The Constitution does not say calendar year. It says "the second Tuesday in August in every fifth year." The question is therefore: what constitutes the fifth year?

If the election occurred on 9 August 2022, the fifth year is the legal period running from 9 August 2026 to 8 August 2027. Within that period, the second Tuesday in August is 11 August 2026. By contrast, 10 August 2027 falls after the fifth year has ended, it is the second day of the sixth year.

So this is not about inventing an "election year." It is about recognising that legal instruments often define periods differently from calendar years. Just as a financial year is a legally defined period, the Constitution's reference to "every fifth year" is a legally defined period that must be given its ordinary meaning rather than rewritten as "after five
