4/10 𝟯. THE LAW REQUIRES DUE PROCESS. In Zimbabwe, you cannot simply pick up a minor. Any care arrangement, fostering, or guardianship must go through the Department of Social Welfare and the Children’s Court to protect both the child and the guardian.

@SirTitusVeTech Real talk! The fan base treats every release like a masterpiece even when it’s clearly mid. Let’s be honest, that album is completely uninspiring, and some of y’all are just too scared to admit it.

This is a very sad story and a greater cause for concern. This case must serve as a major wake-up call to all legislators, policy makers, lawyers, and the general citizenry.

Section 7(4) of the Matrimonial Causes Act recognizes non-financial contributions as one of the factors that must be considered when dividing property upon divorce.

This implies that the division of property upon divorce must not be based solely on the financial contributions that one made toward purchasing the properties.

Non-financial contributions such as caring for children, running the household, and supporting the other spouse’s career, etc., must also be considered.

During his years of unemployment, Mr. Nyamutswa made significant non-financial contributions by running household errands, doing school runs, supporting his wife, and advising her to pursue a career in corporate law. This opened floodgates of opportunities for her and resulted in the purchase of some of the properties in question.

As such, he made non-financial contributions in line with section 7(4) of the Matrimonial Causes Act. Resultantly, he was legally entitled to a fair share of the properties in question.

On the other hand, scores of stay-at-home mothers have walked away with houses, cars, and company shares as proceeds from divorce without even contributing financially toward the purchase of those assets. Their awards were based on their roles in rearing children and providing emotional and social support to their husbands. This principle was upheld by the High and Supreme Courts in cases such as Mhora v Mhora, Usayi v Usayi, Mutizhe v Mutizhe, and Sithole v Sithole, to mention just a few.

One thing that is clear about our family law legal framework is that it is gender-centered and biased toward women.

@hazelwekwagondo Fair point on non-financial contributions, Counsel! But even with cases like Bona and Simbarashe, when the dust settles, the courts still have to untangle massive asset listings fairly you can't just hand over 21 farms and a mansion and call it a day 😂
