Today, in a misguided, wrong, and extremely pro-corporation ruling, a Federal judge granted Uber and Lyft's request for a preliminary injunction blocking just cause protections from going into effect for NYC drivers.

Our statement:

Judge Woods' misguided 53-page decision boils down to one point: he claims the city's law has to cover all of society and sees drivers as a "narrow class." It's an extreme, pro-corporation position that would be a danger to the rights of every working person if it were allowed to stand.

The decision is a punch in the gut to New York City workers and a slap in the face of democracy, endangering the city's ability to enact any workforce-specific regulations. 

Uber and Lyft's greedy business model set out to "gigify" driving jobs, destroying full-time pay in a profession that was once a pathway to the middle class. In 2017, the two companies hired more lobbyists than Walmart, Amazon, and Microsoft combined.

When their lobbyists lost the fight at New York City Hall, they turned to the increasingly conservative, anti-democratic, and pro-corporation courts to do their dirty work of keeping drivers exploited. 

New York City Uber and Lyft drivers fought for more than three years to end the crisis of unfair firings that left families in poverty and debt, with no incomes overnight and no fair recourse. We won't back down from our fight for justice and for just cause – especially after a court decision so extreme and dangerous to the rights of all workers.  

New York City Uber, Lyft, and yellow cab drivers have been on the frontlines of fighting back against the oligarchy for decades. We don't quiver on our knees from setbacks. We fight back. This is far from over – life without poverty, job security as working people, and dignity on the job are non-negotiable. Even heartbroken – we are more determined than ever.

NYTWA members joined @NYCMayor today to shred @nyctaxi penalties, fees, and fines.

The NYC Taxi & Limousine Commission currently collects $1 Million per year in these fines on TLC-licensed drivers. 🤬  

Mayor Mamdani’s Executive Order to reduce fees and fines is a significant step in the right direction, moving the TLC away from being an agency that generates revenue off the backs of low-wage workers.

We need a total overhaul to further reduce the burden of fines on drivers including: remove penalties from all violations that also carry a suspension or revocation; reduce fines so they are proportionate with drivers earnings; and allow for point reduction and remediation.

In NYC, robotaxis wouldn't replace average drivers—they'd replace professional drivers (yellow cabs, Uber, Lyft). So we compared Waymo driving in California to professional for-hire drivers in NYC on vehicle miles traveled (VMT), parking, & safety.

Professional drivers are 14 times safer than private motorists. Waymo has been claiming robotaxis are safer but making comparisons to private motorists. So Sam Schwartz, Open Plans and Hunter College compared robotaxis to professional TLC drivers and concluded:

"The researchers found that across the country, Waymo’s autonomous cars cause crashes that result in injuries or serious death at a rate 1.5 times that of the city’s for-hire fleet."

After a long fight by thousands of NYTWA members, NYT passed the strongest law against unfair deactivations anywhere in the country. After losing at City Hall, Uber and Lyft are using their billions to sue our city in a shameful attempt to stop our hard-fought Local Law 52 (called Intro 276 as a bill) from taking effect!

NYC fast food workers already won protection against unfair firings. Now, drivers have won protections, too.

But greedy Uber and Lyft want to steal our victory and block drivers, who pay thousands of dollars per month just to go to work every day, from the right to notice, just cause, and an independent appeals process not controlled by the companies.

Uber and Lyft still don’t understand that dignity for the drivers is necessary for the industry.
