Bye-election: Exclude our Party and risk nullification of poll, Labour Party advises INEC
The leadership of the Labour Party has advised that if the Independent National Electoral Commission, INEC goes ahead to conduct the August 16, 2025 bye-election without publishing the names of its candidates, and ensuring that its logo appears on the ballot, it will seek the nullification of the election in line with the provision of the law.
The party has also called on well meaning Nigerians to prevail on the Prof Mahmood Yakubu led INEC to respect the Nigeria Constitution and the Electoral Law by discharging its duties as specified by the laws of the land and avoid wasting tax payers money. It accused INEC of working for interests that are anti democratic.
In a statement by the National Publicity Secretary, Obiora Ifoh, Labour Party said that by the electoral Act 2022, any political party which is excluded from participating in any election is expected to approach the court for remedy.
INEC is gambling with the huge resources of the country which are being expended in the conduct of the bye-election that is scheduled to hold on the 16 of August, 2025.
We are not going to be helpless as the law has provided adequate remedies for any act or omission by the commission that has shortchanged the political party or put its image in disrepute.
A political party is expected to guard its image and reputation jealously and Labour Party
will not take any conduct by any agency or regulatory body intended to rubbish its reputation lightly.
One wonders what interest INEC is protecting that will make it throw the entire country into unnecessary crisis and incurring such a colossal financial waste.
By virtue of the Supreme Court decision delivered on the April 4, 2025, the court stated that the issues of leadership is an internal affairs of the party and going by the internal mechanism of the party, the party has held a convention on the 27th of March 2024 at Nnewi, which produced the current leadership as led by Barrister Julius Abure. One wonders what the problem is with INEC.
INEC under Prof. Yakubu must respect the decisions of both the Supreme Court and the leadership of the Labour Party.

The attention of the leadership of the Labour Party has been drawn to a statement by the party's former presidential candidate, Mr. Peter Obi, directing party members to cast their votes for another party in the August 16, 2025 bye-election. The party said that Obi's directive is misleading, mischievous and delusional.
The party is however calling on all our faithful party members to ignore this malicious directive and go ahead with casting of their votes for the Labour Party and their candidates.
It is unfortunate that Obi has turned himself to an irony and a paradox in the Nigeria political space. He is now reputed to have elevated subterfuge in the game of politics and has of late been crying wolf where there is none. He has turned himself into "Uber" politician, not willing to take a position and stand by his decision. He has now booked a place for himself in the Guinness book of records as a person affiliated to many political parties pari pasu, all in his desperation to preside over Nigeria.
Nigerians should not forget in a hurry that it was Peter Obi that created the crisis in the Labour Party which he is now citing as a reason why people should not vote for the party. Peter Obi and Alex Otti the Governor of Abia State hosted the ill-fated and illegal expanded stakeholders meeting in Umuahia, September 4, 2024. He has also co-funded the crisis all these while and went as far as leading a protest match to INEC headquarters against his own party.
His desperation to control the soul of the party has made him go haywire.
A man that received so much goodwill from the party leadership but turned around to pay them with evil. This is why we have maintained that Peter Obi lacks the competence, character and capacity to actualise the vision of a new Nigeria.
What Obi does not know is that Labour Party is on the ballot and our candidates are contesting the election in spite of all his efforts to strangulate the Labour Party. The party unknown to him has done everything within the law to ensure that our candidates participate in the bye-election and of course in all other future election.
We are therefore encouraging our candidates, members and supporters across all the states where bye-election is holding to be focused and ensure that we carry out our civic duties by returning Labour Party and the candidates elected. Nigerians have come to know who Peter Obi really is.

Issue Abure led Labour Party Access Codes to Upload Candidates, Court Directs INEC
Ahead of the August 16, 2025 bye-election and the Federal Capital Territory council election, a High Court has ordered the Independent National Electoral Commission, INEC to accord exclusive recognition to Barrister Julius Abure and Alhaji Umar Farouk Ibrahim as the authentic leadership of the Labour Party.
The court presided over by His Lordship, Hon Justice Mustapha A. Ramat of the Nasarawa state division had on July 23, 2025 in a SUIT NO. NSD/LF.84/2024 in an interlocutory order directed INEC to also grant Access Code to Julius Abure and Alhaji Umar Farouk Ibrahim to upload the names and particulars of their nominated candidates for the bye elections and the FCT Area Council elections as scheduled by the INEC.
INEC has refused to publish the names of the nominated candidates by the Labour Party in a bye-election scheduled to hold on Saturday as well as the FCT council elections scheduled for early 2026.
Below is the extract of the Order of the Court. (Also attached is the Original Copy of the Court Order.)
Praying for the following orders:
1. AN ORDER OF INTERLOCUTORY INJUNCTION OF THIS HONOURABLE COURT directing the Defendant (Independent National Electoral Commission) to accord exclusive recognition to only the officers of Labour Party including the 2nd and 3rd Plaintiffs Julius (Abure and Alhaji Umar Farouk Ibrahim) as the National Chairman and National Secretary, who emerged from the convention held at Nnewi, Anambra State on the 27” day of March, 2024 as the authentic officers of the 1st Plaintiff (Labour Party) pending the hearing and determination of the substantive suit.
2. AN ORDER of Interim Injunction restraining the Defendant from dealing in any way-or manner or otherwise according any recognition whatsoever to any person (s) claiming to be officers of the 1st Plaintiff, except the officers who emerged from the convention held at Nnewi, Anambra State on the 27th day of March, 2024 pending the hearing and determination of the substantive suit.
3. AN INTERLOCUTORY ORDER directing the Defendant to grant access Code to the Plaintiffs to upload the names and particulars of their nominated candidates for the bye elections of FCT Area Council Elections scheduled by the Defendant.
4. AN ORDER of this Honourable Court granting accelerated hearing of this suit.
5. AND for such further order or other orders as the Honourable Court may deem fit to make in the circumstances.
AND AFTER HEARING the submissions of Idris Yakubu, MCI Arb. UK (Esq.) Counsel for Plaintiffs and none appearance of the Defendant after dully served with the Motion on Notice (M1/2025) dated 17th day of July, 2025.
IT 1S HEREBY ORDERED that:
The application/reliefs sought as herein contained are hereby granted as prayed.
Case is accordingly adjournment to 22nd September, 2025 for hearing of the main case.

Reacting to this development, the National Publicity Secretary of the Labour Party, Obiora Ifoh, applauded the intervention of the court describing it as a welcome development and an order which will right the many wrongs meted to the authentic leadership of the party.
According to Obiora Ifoh, "We received this intervention with a heart full of gratitude. We are however hoping that INEC as a law abiding institution, will do the needful by formally publishing the names of our nominees for the bye election and the FCT council elections without further delay.
"We are however not happy that our candidates have not been giving equal opportunity and time to campaign like other political parties. As it stands now, our candidates, due to reasons not of theirs were prevented from campaigning. This is clearly a systemic route orchestrated by INEC to perpetually prevent Labour Party and their candidates from favourably participating in elections. Recall that in Ondo state, INEC granted Labour Party's governorship candidate access code barely 24 hour to the election. This has become a norm and we will not take such treatment any longer.
"Finally, we urge our candidates not to be undaunted or dismayed by these glaring limitations. Labour Party is a household name. We expect nothing but victory in all these contested offices. We also call on members of the party in the affected states to once more show their indomitable and 'never die spirit' to return our candidates."
