Vodafone has massive legitimate claims pending with GOI โ โน1,482 cr+ in GST/service tax refund disputes, income tax refunds pending for years, manipulated GST demands, and the extraordinary #OTSC case of โน3,857 crores where the Government ITSELF sought court withdrawal โ and the court refused. Litigant wants to leave. Judge wonโt let it. Justice Misra โ God only knows what drives this judicial enthusiasm when the sovereign itself seeks closure. OTSC resolution alone means โน3,000โ4,000 cr in DOT refunds plus removal of โน15,000+ cr contingent liability from the entire industry.
AGR โ perhaps Indiaโs most creative regulatory fiction. @DoT_India gets its cut whether you earn from telecom or ANY other business. Every rupee, every stream. Supreme Court upheld it โ but upholding a definition doesnโt make it just. This wasnโt regulation. This was extraction dressed in legal language, bleeding an industry for over a decade.
Digital Bharat Nidhi sits on โน80,000โ86,000 crores. Biggest contributor? Vodafone. Utilisation? Largely nothing. Government keeps extracting SUC levies, spectrum charges and AGR dues from the very company that filled it. These contributions were collected for a specific purpose โ universal digital access โ not as a slush fund for indefinite parking. If unutilised, they must be refunded to contributors. Governments are accountable to their citizens. Public money collected under a stated mandate cannot simply sit while the same contributors are bled dry elsewhere. Filling a tank nobody drives is not policy. It is impunity.
BSNL got โน3,00,000 crores of taxpayer money while haemorrhaging market share. Vodafone built its network with private capital and fights alone for survival. The silence around this asymmetry is as breathtaking as the asymmetry itself.
Starkest injustice โ spectrum. #RCom converted 800 MHz CDMA spectrum across 16 circles to LTE for just โน5,384 crores under administrative allocation. #Vodafone and #Bhartiartl #ttml etc paid TENS OF THOUSANDS OF CRORES through competitive auctions for comparable holdings. Same spectrum. Same circles. Radically different price. If this isnโt unequal treatment institutionalised in policy โ what is?
Post-merger Vodafone carries surplus spectrum it cannot use and cannot surrender. Forced liability. Zero benefit.
And then the final insult โ the government took equity in Vodafone, not as a fair investor but against manipulated liabilities, effectively robbing existing shareholders. That equity, extracted under duress against contestable dues, must be cancelled or reversed. Fairness and judicial integrity demand nothing less.
Through all of this @AdityaBirlaGroup has not flinched. Not walked. You donโt commit this conviction to a lost cause. You do it when truth is on your side and reversals are coming.
Vodafone will survive and thrive. Liabilities contestable. Refunds real. Corpus real. Undervaluation real. Buy or hold #idea for an one year for true valuation to surface.
Hats off to #Vodafone and @AdityaBirlaGroup โ fighting not just for shareholders but for every investor and citizen who believes regulatory fairness is not too much to ask from the worldโs largest democracy . By accepting โน23,649 crore relief to #VodafoneIdea, #DoT has now effectively admitted that #AGR calculation errors did exist. If calculation errors existed for one operator, principles of justice, equality and fair play demand that the same opportunity be extended to #BhartiAirtel, #TTML and every #telecom company adversely impacted by the flawed AGR regime.
The consequences of the order delivered by Justice Misra devastated the telecom sector by burdening companies not only with disputed dues, but also crushing interest, penalty and even interest on penalty. When a litigant had succeeded till the High Court, imposing such extraordinary liabilities after reversal by the Supreme Court was excessive and resulted in grave financial destruction. If the originating calculations by #DoT itself were defective, then the very basis of penal consequences stands seriously undermined.
From this also flows an equally important question โ why should Government continue to hold equity in #Idea when circumstances leading to such distress were materially created by failures within the system itself? Instead of forced equity conversion, #Vodafone should now rightfully demand, and @narendramodi Government should accept, that #VodafoneIdea be allowed to pay spectrum dues and other liabilities in the ordinary course of business.
Not only should Government equity in #Idea be cancelled, reduced or readjusted to the extent of AGR correction and its consequential impact, but the company must also be given a fair opportunity to revive naturally. @AdityaBirlaGrp should examine all remedial measures in the upcoming #Idea board meeting.
Investors should note: the story of #Idea may be far from over.
