The Tax Appeals Tribunal has issued a significant & extremely consequential judgement.
The Tribunal has essentially turned Legal Notice 37/2011 on the guidelines on the allowability of bad deb on its head & sent the banking sector back to the drawing board.
The idea that bad debt are wholly & exclusively incurred in the normal course of business & therefore not deemed as being capital in nature has been thrown out.
In its determination in Appeal No.E1149/2024, the Tribunal has determined that the principal component of a loan facility is capital & therefore not eligible for deductible purposes in the event that a loan is written off.
The Tribunal has argued that the Principal is a financial asset that is deployed in generating interest.
This portends significant, & extremely grave, implications for the banking sector & the economy as a whole.
Inevitably, banks will recalibrate their risk posture in the market in view of this.
Harvard has set an example for other higher-ed institutions – rejecting an unlawful and ham-handed attempt to stifle academic freedom, while taking concrete steps to make sure all students at Harvard can benefit from an environment of intellectual inquiry, rigorous debate and mutual respect. Let’s hope other institutions follow suit.

Abductions only serve to invigorate the protests. Not only is it unconstitutional but tantamount to a wrong prescription for what the country is suffering from.
