The First Amendment itself is concerned with state action. If begins “Congress shall make no law.” It is not violated by parents, religious colleges, social media platforms, TV networks or sports leagues. Even when these things are visible to the public.
Censorship in those cases might be immoral or hypocritical. It might even violate other laws or contract.
But being in public does not make you a public employer for first amendment purposes. And it is astounding that this continues to need to be said.

Today, the Court of Appeal has overturned the High Court’s ruling on the Palestine Action ban, which previously deemed it “disproportionate”.
The group will remain proscribed as a terrorist organisation.
The judiciary has seen sense. The High Court’s ruling was a step backward in the fight against extremism, and we welcome the Court of Appeal’s correction.
British Jews’ faith in the justice system has been rapidly waning, so this decision cannot have come sooner. It recognises the violently criminal nature of Palestine Action and the impact of its activities, which terrorise ordinary people and the Jewish community. Judges have finally declared that criminality and terrorism carried out ‘for Palestine’ will have consequences.
The next step is for prosecutors to act on all of the arrests that the police have made of those involved in or expressing support for this heinous organisation.
This country’s overdue campaign against shocking levels of extremism is only just beginning.
How do they not feel embarrassment, constantly claiming they can end all the world's problems with some small fraction of the amount of money they spend every single year?
