The Attorney General wasn’t wrong.
Genocide is inherently a form of mass killing; and while it can be distinguished from other types of mass killing based on intent, traditionally the umbrella term, ‘Qathulu Aammu’ was used in Dhivehi communications to capture genocide. This mirrors our own QA’s usage of ‘Aniyaa’ to encapsulate torture without distinguishing it from lesser forms of ‘aniyaa’ that don’t meet the legal threshold of torture.
If the proposed statutory text explicitly builds in the criteria of intent from the 1948 Convention, using the familiar term, ‘Qathulu Aammu’ is valid and it is more publicly accessible.
A more productive conversation would perhaps be for the former Chief Justice to suggest an alternative.
