ERROR FOUR: THE KIDNAPPING PARADOX — THE COURT CONTRADICTS ITSELF

What the Supreme Court did

My lord Justice Emmanuel Agim, in the same remittal judgment, found that Nigerian agents kidnapped and abducted Kanu and subjected him to extraordinary rendition from Kenya to Nigeria.

He described the conduct as:

“prohibited by law”;
“brazen lawlessness”;
and said the prosecution had become “unfair and oppressive.”
The fatal contradiction

The Court found the unlawful seizure.

The Court identified the illegality.

The Court called it kidnapping.

The Court called it abduction.

The Court called it prohibited by law.

And yet the trial continued.

THE COURT NAMED THE WRONG. THEN REFUSED TO GIVE THE WRONG ITS LEGAL CONSEQUENCE.

That is not a failure to find the law.

That is a failure to apply the law.

But the wrong was not merely a moral wrong. It was a crime under the law of the place where it occurred — and it was also terrorism under Nigeria's own law.

FIRST: KENYAN LAW

Kenya has a Penal Code (Cap 63). It defines kidnapping in plain terms:

“Any person who conveys any person beyond the limits of Kenya without the consent of that person ... is said to kidnap that person from Kenya.”

And it prescribes punishment:

“Any person who kidnaps any person from Kenya or from lawful guardianship is guilty of a felony and is liable to imprisonment for seven years.”

Kanu was in Kenya. He was conveyed beyond the limits of Kenya without his consent.

That is the statutory definition of kidnapping under Kenyan law.

The very act the Supreme Court found — kidnapping from Kenya — is a felony in Kenya, punishable by seven years' imprisonment.

A Kenyan court has since confirmed this. The High Court of Kenya declared Kanu's abduction and forcible removal from Kenya “unlawful and unconstitutional,” holding that there were “no extradition proceedings” and that the “abduction and incommunicado confinement were not lawful acts.”

SECOND: NIGERIAN LAW — THE TPPA 2022

But the more devastating point is this:

Nigeria's own terrorism law defines the State's conduct as terrorism.

The Terrorism (Prevention and Prohibition) Act 2022 (TPPA) — the living law in Nigeria on 15 December 2023 and today — defines an “act of terrorism” to include:

Section 2(3)(f) — an act that violates an international treaty or resolution to which Nigeria is a party.
Section 2(3)(g)(ii) — an act that involves or results in the kidnapping of a person.
The African Charter on Human and Peoples' Rights is a treaty to which Nigeria is a party. It has been domesticated into Nigerian law. It prohibits arbitrary arrest and detention, and it prohibits the extra-judicial removal of a person from one country to another without due process.

So by the plain text of Nigeria's own terrorism law:

The State kidnapped Kanu → Section 2(3)(g)(ii) — an act of terrorism.

The State violated the African Charter through extraordinary rendition → Section 2(3)(f) — an act of terrorism.

The State is a terrorist by its own law.

The consequence

So here is the position:

The TPPA 2022 says kidnapping is terrorism.
The TPPA 2022 says treaty violation is terrorism.
The Supreme Court found that Nigeria kidnapped Kanu.
The Supreme Court found that Nigeria violated the African Charter through extraordinary rendition.
The same Court then allowed the State to prosecute Kanu for terrorism.
The State cannot be both the terrorist and the prosecutor.

The perpetrator of the crime cannot be the accuser.

He who goes to equity must go with clean hands.

Around 3pm, a whole street was robbed by seven armed men, and he was the only one on duty.

They began exchanging gunfire with him (Mr. Anthony). Long story short, he took down six of those heavily armed men. One of them escaped and went to call for reinforcements, which consisted of 15 new squad members.

Throughout all this, Mr. Anthony didn't back down; he stood his ground, honored the oath he pledged to Nigerian civilians, and protected everyone in the area.

He also bravely took down the reinforced 15 armed men. They shot an RPG at the complex, which had civilians and a baby inside, but he rescued everyone. Despite heavy fire, he didn’t back down.

About two years ago, a fellow called Fapohunda, a Yoruba, floated a restructuring idea. He went ahead and scripted a position paper prepared as a bill for a restructured Nigeria. His paper went viral, people started meeting and discussing his paper left, right and center. Many, especially Ndi Igbo who are always the least informed, went to the market with Fapohunda's idea and mostly tearing it to pieces because of the way it muddled Igbo region.

Fast forward last week, another Yoruba floated a Restructuring Whatsapp Group (with what intent?) His group expanded and incorporated many who genuinely wanted Restructuring. (Yours sincerely decline) Ndi Igbo in their unplanned desperation to extricate themselves from their Nigerian prison, bought the Yoruba scheme hookline and sinker. Now you be the judge from where the so called citizens talk on restructuring has landed Igbo.
The most annoying is the cry by these Igbo 'leaders' of 'Yoruba Betrayal.' So at his age and experience, what were they expecting, something different from Ndi Yoruba? Wonders shall never end.
With eyes wide open, Igbo 'leaders' again walked into a trap that nearly consumed them. By the way, the so called restructuring Conference produced a formal report. Ndi Igbo walked out on the report and went on social media to shed crocodile tears. But see, in the next 50 years, that report and not Igbo walkout will enter historical annals. That is why you must look deep before you leap.
Compare Igbo participation with Ijaw nation's out right rejection of the Yoruba contrived conference! And who says onye Igbo cannot set up his own conference on restructuring, set out a restructured map for Nigeria, and invite others to participate? Should we always be the fall guys who after being played over and over resort to crying over Yoruba trickery?
Yoruba will set up another one tomorrow and Igbo 'leaders' will pack bag and baggage and head to Abuja. Aru!

Amnesty International has documented shocking war crimes in Southern Cameroons Anglophone regions also known as Ambazonia including killings and mutilations by Cameroun forces in places like Bafut. Civilians pay the price while the world looks away.

Norway, meanwhile, has held Ambazonian leader Dr. Cho Ayaba in pretrial detention since 2024 on allegations charges of inciting war crimes and crimes against humanity, based largely on his public statements and alleged remote role. He denies everything and calls it political. His trial is still pending.

So here’s the conversation starter:

If documented atrocities by Cameroonian forces keep happening with no consequence, why is the first major international case targeting a Ambazonia leader sitting in a Norwegian jail? Is this even-handed justice under universal jurisdiction or does it show whose crimes get prosecuted and whose get quietly tolerated?

When do countries like Norway stop treating this as a distant African problem and start applying the same standard to every party in the conflict? And how much do old colonial ties to France and Britain still shape who gets protected and who gets pursued?

A young Fulani man, who says he was born and raised in Cross River State, made serious allegations during a video call with D English Alhaji, claiming that some influential Fulani politicians, imams and wealthy individuals are allegedly involved in sponsoring kidnapping, terrorism and violence in Nigeria.

He went further by naming individuals he claimed were behind some of these activities.

These are serious allegations and should not simply be dismissed or accepted without investigation. If the individuals named have evidence against them, the appropriate security agencies should investigate and prosecute anyone found responsible, regardless of ethnicity, religion or political position.

Terrorism and kidnapping are not the crimes of an entire ethnic or religious group. The focus should be on identifying the individuals financing, organizing and enabling these criminal networks and holding them accountable under the law.

Nigerians deserve the truth, justice and security.
