On the Supreme Court of Canada's Instagram account (yes, you read that right), the Court is promoting its distinct flag as a symbol of its "independence from the other branches of government."
The Canadian flag represents the state, of which the judiciary is a part. Judges, like politicians, are state actors, and like all state actors, they are subordinate and subject to the law, including and especially the Constitution. The principle of judicial independence does not detract from that fact.
The Court's distinct flag is therefore not a symbol of independence from government interference. It rather suggests independence from the state itself and, therefore, that the justices of the Supreme Court are not subordinate and subject to Canada's Constitution.
It is, in short, not a symbol of judicial independence but of judicial power.
This view is common in Canada and Europe, stronger in the political and cultural elites than among ordinary citizens, and it's a dangerously stupid view. Signing the North Atlantic alliance in 1949 founded 75 years of peace that made the EU possible. Break it and own chaos.

Viktor Orbán has been a very consequential PM - probably the most consequential Hungary has ever had. The economy has strengthened, the city of Budapest has been transformed, and Hungary’s family policies and determination to keep its culture have been studied around the world. He and I differed on Ukraine but I thought he was dead right to defy the EU, on illegal immigration especially. Why should a sovereign nation be bullied by Brussels into policies that would jeopardise its future as a distinct people? Under Orbán, Budapest became something of a haven for conservative intellectuals. This has been a significant point of soft power for Hungary and I don’t expect the new government will want that to change.
Exactly right. There was never doubt that this was a free and fair election, no matter the outcome.
Yet for several weeks and months, the international liberal commentariat class shamelessly spewed baseless doubts, questioning election integrity, questioning whether there’d be a concession, Moscow meddling with the vote, etc. All non-sense.
These are all based on tired caricatures and old stereotypes of Central Europe. In reality, especially after the twentieth century, Hungarians and neighboring countries likely have a better appreciation of actual freedom and democracy than their distant critics in the liberal elite.
I suspect that many of the so-called experts breathlessly airing opinions and “analysis” on Hungary’s election this week would fail the most basic test: finding the country on an unlabeled map.
But ... but ... but, I was told by so many experts and journalists in the West that this would never happen, that Orban is a fascist dictator who would never surrender power! How many other lies about Orban and the Hungary he led have been told...?
Budapest under Viktor Orbán is one of the safest capitals in Europe for Jews, and one of the very few where a Jew can walk to synagogue on Shabbat morning wearing a tallit and kippah without fear.
This is no accident.
It stems from a responsible immigration policy, zero tolerance for antisemitism, and consistent enforcement of the law.
For years, Orbán’s government has invested heavily in restoring synagogues across Hungary, rehabilitating Jewish cemeteries, and affirming Jewish heritage as an inseparable part of the Hungarian national identity.
When the October 7 massacre occurred, Hungary acted immediately: it hosted Israeli delegations, became a safe haven for Israeli sports teams, banned demonstrations supporting the terrorist organization Hamas, and in a powerful symbolic gesture renamed the square in front of the Great Synagogue “October 7 Square” in memory of the victims.
When the Zionist Youth Congress in Basel faced a boycott, Budapest opened its doors wide and even sent a government minister to show support.
This continues a consistent policy: Hungary has repeatedly blocked anti-Israel resolutions in the European Union.
Budapest under Orbán stands in stark contrast to Brussels, where the October 7 atrocities are celebrated in the streets and hostility toward Jews has become normalized, even rewarded, in academia.
As someone who has seen the sharp rise in antisemitism across Europe, I feel compelled to express deep gratitude for Viktor Orbán’s courageous leadership.
I wish him every success in the elections tomorrow.
