It is puzzling that Advocate Matthew Chaskalson seemingly wants to place the burden of intent on public representatives, when they receive information from public officials or any member of the public for that matter.
Surely it is strange that MP’s and MPL’s are expected to curate or control the intent of a question or information provided to them by a public official or a member of society.
The duty of a public representative ought to be to interrogate whether there is any merit or public interest in relation to information received, and if that determination is made, the necessary question/s must be posed as part of the constitutional duty to exercise oversight.
If someone says to an MP/MPL there is a stadium which was left unfinished yet payments were made to a service provider, and that service provider pays kickbacks to municipal officials in order keep receiving contracts despite this, the person volunteering the information may have an intent to be the one who is contracted in place of that service provider.
The duty of a public representative however is not to investigate such intent, it is to protect municipal funds from misuse.
If we were to prioritise verifying intent above exercising oversight, then we would not be doing our jobs.
What was the intent by Lt General Nhlanhla Mkhwanazi volunteering progress on the murder of Kieran “AKA” Forbes after Julius Malema publicly raised his concern on the slow progress of the case? Does it matter that Lt Gen Mkhwanazi expressed his distrust of Bheki Cele, his political principle at the time to Julius Malema, or that he expressed the illiteracy of his direct supervisor Fannie Masemola?
No it does not, because he assured a public representative of progress in a criminal matter of public interest.
Sometimes MP’s receive information from the colleagues of Ministers whose intent may be the ultimate removal of such Ministers, the question is should oversight be ignored, because of concerns regarding possible nefarious intent?
In 2014, Blaise Compaore in Burkina Faso tried to extend his term after being in power for 27 years, and Burkinabè people decided that it won’t be happening.
A mass uprising took place and Compaore attempted through brute force to crush protests. He failed and fled Burkina Faso.
Now we have Zimbabweans giving us all sorts of excuses about why they keep a useless and corrupt dictator power and allowing him to extend his term.
That Mnangagwa is a brutal dictator cannot be an excuse not to take to the streets and remove him. It is a sign of cowardice and defeatist disposition.
Zimbabweans portraying themselves as helpless victims of a brutal dictator is pathetic.
There has not been a single protest in Zimbabwe over the Mnangagwa term extension. None. Yet they expect South Africa to fight Mnangagwa for them.
There is no one who is going to save Zimbabwe from Mnangagwa and ZANU PF but Zimbabweans themselves.
Zimbabweans must stop being cowards!

Tony Leon is accused of interfering with the work of ministers through his firm Resolve Communications, lobbying them on behalf of private clients, and allegedly threatening to have ministers removed from power if they didn’t align with his interests. He is also accused of trying to profit from his proximity to DA-led governments.
Yet it is Julius Malema who is under public scrutiny for having dinner and reporting alleged criminal activity — a public service, by the way.
President @Julius_S_Malema is being blamed for an 18 member committee that did not summon General Khan to appear before it at the Ad Hoc Committee.
At this rate the CIC will be blamed for not appearing in front of the Madlanga Commission, even though no one invited him.
Ok Mr Accountability, why have you not posted ANY vid from the Ad Hoc Committee where you disagreed?
Why didn’t you process an appearance before Police PC? You know why - because you rather grandstand in the media and on socials than using constitutional powers of the committee that you Chair for accountability.
Instead of running your mouth with long posts and media interviews that get your lawyers letters, get them before the PC! It’s simple like that! That’s accountability!
