The final version of my article, "Presidentialism at the Highest Ebb: Executive Power in the Age of Trump," is published in the Dayton Law Review. In the article, I argue that the Roberts Court has flipped Youngstown on its head, culminating (so far) in Trump v. US.

Not as persuasive as (e.g.) Profs @kurtlash1, @RandyEBarnett, @ilan_wurman, Epstein, or Estreicher. A bit disappointing following years of claims that he'd decisively resolve the issue. Definitely interesting to read a minority view on the scholarship on this issue, though.
Very interesting to claim @AnthonyMKreis is a “minority view” in the scholarship when Wurman and co (would tag but they have me blocked) just rushed shoddy partisan work out as fast as possible
Posting my draft of “Discovering the Historical Anglo-American Constitution.”
I trace birthright citizenship from the 1100s to the 1770s and show that the English common-law rule of natural-born subjects was always tied to territory and jurisdiction.

Author copies are in! This book represents over a decade of research, work, and seeing it in print is surreal. @USCPress You can pre-order now! https://t.co/6Vvz2BMRhs
@kurtlash1@Alexand16730477 Again, I look forward to your attempt to show how such quotes—but not his own actions—convey his “true views.” And that’s to say nothing of the other contradictory statements he made about Black people throughout his life.
And at any rate, I look forward to seeing how you try and square similar quotes with the fact that Jefferson owned ~600 humans throughout his life, freed none of them upon his death, sold people and destroyed families, and believed that Black people were politically, intellectually, and socially inferior to white people. Thanks for the exchange.
@kurtlash1 You dismissed my first cite to Finkelman out of hand with no justification for doing so, which leads me to believe you just dislike his conclusions.
@kurtlash1 Notes on the State of Virginia. Refers to “transient” love of Black people, I.e., they don’t love in the same way white people do. Etc.
What’s wrong with Finkelman? You dislike his findings?
