We have filed our brief with the U.S. Court of Appeals for the Federal Circuit challenging U.S. Department of Veterans Affairs rules that deny veterans the full education benefits they earned.
In Rudisill v. McDonough (2024), the Supreme Court of the United States made it clear that veterans who qualify for both the Montgomery GI Bill and the Post-9/11 GI Bill may receive up to 48 months of combined education benefits. However, the U.S. Department of Veterans Affairs has issued rules adding restrictions Congress never intended, including requiring a break in service before accessing the full benefits.
That is not what the law says, and it is not what veterans earned. Veterans kept their promise to serve. Now it is time for our nation to Honor the Contract.
