Excellent catch indeed @SGJohnsson! Given the SEC "cannot comment on an ongoing investigation", surely they will not refer to the investigation at all? But then just using correlation seems to again implicitly accept ETH is a commodity which I do not think they will want to do either at this point (plus giving all the power to the statistical gods)
