Middle District of Florida Judge Timothy Corrigan, appointed by President Bush, will assume senior status in November 2024. This creates a fourth vacancy on the court, which currently has one nominee pending.
New: First Circuit Judge William Kayatta, appointed by President Obama in 2013, will assume senior status when a successor is confirmed. Judge Kayatta sits in Maine. President Biden has already appointed 3 judges to the 6-member court, with another nominee pending.
@IrishGuy1984@rstefens I'm not sure why that would matter. His seat is in Virginia, not Maryland, and Virginia's senators have moved very quickly on their other judicial vacancies.

There’s now only one circuit judge vacancy without a nominee. If you’re a circuit judge and you want Biden and a Dem Senate to confirm your successor, retire NOW. Several judges did so at the end of 2021, giving the WH and Senate enough time to find and confirm replacements.
If confirmed, Berner will also be the third-ever openly lesbian judge on any U.S. appeals court.
She'd be the first on the U.S. Court of Appeals for the Fourth Circuit.

President Joe Biden nominated the top lawyer at a major labor union and a Muslim American attorney to become federal appeals court judges as part of a continued effort by the White House to diversify the federal judiciary https://t.co/27yveb5ibe @nateraymond
Biden is nominating Adeel Mangi to the Third Circuit and Nicole Berner, the top lawyer at the union SEIU, to the Fourth Circuit. Mangi will be the nation's first Muslim American federal appeals court judge and Berner will be CA4's first LGBTQ judge.
🧵MORE progress on federal judges.
@apwillweissert: “President Biden on Wednesday announced 5 nominees to federal judgeships including the first Muslim-American on any circuit court, looking to add to more than 150 of his judicial selections who have already been confirmed.” 1/
The Senate confirmed U.S. District Judge Ana de Alba to the Ninth Circuit by a 48-43 vote. There are now 3 circuit judge nominees awaiting floor votes, 1 circuit judge nominee awaiting a committee vote, and 3 circuit judge vacancies without a nominee.
Nothing in the 14-page document, or the one-page cover note, addresses the elephant in the room:
*Whatever* rules the justices *say* they are bound to follow, *who* is going to enforce those rules—and how?
