@DoniTheDon_ People saying commerce clause are wrong, it's the supremacy clause. Article 6 Clause 2. It quite literally says all federal law is supreme and all judges are bound by it. It does not say laws must be constitutional, it says 'in pursuance thereof' meaning 'up to interpretation'.

Expecting them to remain true to the bill of rights is simply a matter of interpretation. As for the congress themselves, the bill of rights is irrelevant according to Article VI section 2.
