@kmacuich_67 @CourtTV The prosecution didn't charge him with a BUI/DUI. Since they didn't charge him with that offense they kept the hospital blood draw out as not being relevant.

@kmacuich_67 @CourtTV Hospital did a blood draw and it was a 0. They didn't try and charge him with an BUI/DUI because then that evidence would have come in as relevant. The prosecution didn't want that to happen so they left off the charge and just said he had been drinking to confuse the issue.
