My opinion is that FCCPC v. UBA is one of those court decisions our Banks aren’t going to like.
In that case, UBA went to court to argue that, as a CBN-licensed bank, the FCCPC should have no say over it on consumer matters.
The Federal High Court in Abuja didn’t agree!!!
Not even slightly.
Here’s what the case was really about.
UBA leaned on Section 251(1)(d) of the Constitution and Section 65(1)(a) of BOFIA 2020, both of which place banking regulation squarely within the CBN’s domain.
The FCCPC, on the other hand, relied on Section 104 of the FCCPA 2018 which provides that when it comes to competition and consumer protection, the Act takes priority where there’s a clash.
So, in simple terms, the argument was this…
“Only the CBN can regulate us” versus “Consumer protection applies across every sector, including banking.”
The court agreed with the FCCPC!!!
It confirmed that the Commission can investigate consumer complaints involving banks. It also fined UBA N2 million for bringing what it considered a frivolous case.
Why does this matter?
For a long time, there has been a quiet assumption that once the CBN is involved, that’s the end of the story.
This judgment says otherwise.
The CBN still handles licensing and supervision. But when it comes to how customers are treated, the FCCPC now has firm ground to step in.
For banks and fintechs, this changes the compliance conversation.
Your complaints process, customer terms, and even how you handle data-related issues now sit within a more layered regulatory environment.
For consumers, it’s simpler.
Your options don’t end with the bank.
The message is clear.
Banks answer to the CBN.
They also answer to consumer protection law.

At nine months old, a failed measles injection by a local nurse caused avascular necrosis, leading to lifelong hip pain and leg weakness until his hip replacement surgery
Four of his siblings died in childhood (likely related to sickle cell trait in the family), making his survival a "statistical miracle"
At age 10, he dropped out of school due to poverty but returned after his mother worked as a cleaner for six years to pay his fees

He got a diploma in computer science and used chess winnings to support himself through school
Founded Chess in Slums Africa in September 2018 as a volunteer-driven nonprofit after visiting slums like Majidun
The organization has reached thousands of underprivileged kids, including producing a 10-year-old champion with cerebral palsy
Tunde Onakoya broke the Guinness World Record for the longest chess marathon (over 60 hours) in Times Square, New York, in 2024

My name is Engineer Peter Obidike, a beneficiary of the Lagos State Consumer Protection Agency (LASCOPA).
Recently, I transported goods valued at ₦10 million from Abuja to Lagos through a well-known transport company.
During the offloading process, one of the items was accidentally dropped and damaged. The affected item was worth ₦2.5 million
Upon discovering the damage, I promptly contacted the transport company to seek redress.
However, all my efforts to get them to accept responsibility and resolve the issue were unsuccessful.
Consequently, I reached out to LASCOPA for intervention. The Agency responded swiftly and handled the matter with professionalism and efficiency.
I am pleased to state that I have now received a full refund for the damaged item.
I sincerely appreciate LASCOPA for their prompt support and effective intervention. I also commend the Lagos State Government for establishing an agency that truly protects and stands up for consumers.

After over two decades of advocating for consumer rights and protection, I've observed that many businesses in Nigeria still perceive consumer protection incorrectly.
They view it as a burden, merely a compliance issue, or something to address only when problems arise. This mindset is precisely what hinders their growth.
Consumer protection is not solely about:

• Meeting the bare minimum to satisfy regulators
This approach is defensive.
