We trust that the government considers communications made on social media, including this platform. This particular post is addressed to the @MoHFW_INDIA requesting honorable @JPNadda ji to intervene.
This grievance pertains to the hostile position taken by the undergraduate board of the National Medical Commission against the teachers with medical MSc, Ph.D qualifications regarding MBBS examinership.
In its document No. I4021-8-2023-UGMEB dated 12th June 2023 and titled "Guidelines under Graduate Medical Education Regulation 2023", the following was stated:
"Person appointed as an examiner in the particular subject must have at least four years of total teaching experience as Assistant Professor after obtaining postgraduate degree in the subject in a college affiliated to a recognized medical college (by UGMEB of NMC)."
The above statement did not discriminate teachers with medical MSc, Ph.D qualifications. This document was eventually retracted and the new document in its place "Competency Based Medical Education (CBME) Curriculum 2024 dated 12-09-2024" states:
"Person appointed as an examiner in the particular subject must have at least three years of total teaching experience as Assistant Professor after obtaining postgraduate degree following MBBS, in the concerned subject in a college affiliated to a recognized medical college (by UGMEB of NMC)."
As evident, the words "following MBBS" were subsequently added with the sole intention to deny examinership to teachers with medical MSc, Ph.D qualifications, including the Professors with decades of teaching experience.
Aggrieved by this discrimination and injustice, several professors, including members of this association had filed writ petitions in various High Courts across the country.
NMC submitted in those petitions that the guidelines apply prospectively to those teachers appointed after the publications of the guidelines and that the existing teachers will not be affected. Trusting this position, the courts had disposed the petitions.
However, NMC did not make this position explicit in its published guidelines, issued a public statement on its website nor sent circulars to all the health universities.
Therefore, to all the concerned universities, only those teachers with basic MBBS qualifications are eligible and they continue to deny examinership as they continue to rely on the above mentioned CBME 2024 guidelines.
Attached is a letter from NTR University of Health Sciences that continues to deny examinership to MSc, Ph.D qualified teachers, which supports our position.
As a result, aggrieved members will be forced to file fresh petitions in various high courts, which will reflect poorly on the NMC and the government.
UG board of the NMC states one thing in the court and does the exact opposite in real practice. This dishonesty continues to trouble our members.
Therefore, the NMC must amend its guidelines so that there is no ambiguity regarding the eligibility of teachers with medical MSc, Ph.D qualifications by removing the words "following MBBS" in its guidelines.

It is always about 'pride and prejudice'. We can see and sense it around us all the time. The pride in oneself automatically translates into prejudice toward others. The most significant dishonesty exhibited by the NMC is when it lies through its teeth.
While assuring that the existing faculty won't be affected, it is relentlessly working to the detriment of MSc/PhD teachers by modifying guidelines and releasing disparaging FAQs.
The intent is clear, and the mischief is obvious!
Why can't existing teachers in Pharmacology and Microbiology apply for new jobs or higher posts in other colleges or in other states?
Why has the NMC blocked their rights to pursue better prospects or working conditions elsewhere?
This is the denial of a fundamental right.

Citizens are fed up and distressed with the current judicial system.

On August 1, 2023, the NMC released a gazetted notification on the Competency-Based Medical Education (CBME) guidelines, disentitling faculty with medical MSc/PhD qualifications from serving as examiners. This was stated under the heading 'Appointment of Examiners' on page 58 of the notification. Incidentally, the 'Criteria for passing in a subject', is also present on Page 58 of the document.
This was reiterated in Question No. 14 of the FAQ on the CBME course curriculum published on September 13, 2023.
On September 1, 2023, the UG board of NMC made two amendments regarding 'Criteria for passing in a subject' mentioned on page 58 via a corrigendum F. No.U/14021/8/2023-UGMEB.
Subsequently, on October 3, 2023, NMC issued a public notice stating that September 1, 2023's corrigendum would not be applicable retrospectively.
Meanwhile, several writ petitions were filed in the High Courts of Rajasthan, Kerala, Uttar Pradesh, Karnataka, and Andhra Pradesh against the discriminatory guideline of NMC.
Facing numerous lawsuits and realizing its error, NMC made a submission in the Andhra Pradesh High Court, claiming that as per its public notice dated October 3, 2023, the guidelines 'will only apply prospectively, if the Writ Petitioners had previous experience as Examiners'.
While the public notice was with regards to the corrigendum on 'criteria for passing in a subject', NMC applied it to the 'Appointment of Examiners', taking advantage of the fact that it too appeared on Page 58.
This is how @NMC_IND cleverly but cunningly misled the courts into believing it using an unrelated document.
Nonetheless, NMC's submission in the Allahabad High Court that "the effect of CBME guidelines 2023 will not disturb the old faculty. They will continue to remain eligible for becoming the examiner. The CBME guidelines 2023 shall be applicable to new appointments" has given relief to the existing teachers.
However, this discrimination is still unacceptable and the NMMTA has called for its retraction. All faculties with 4 years of teaching experience must be considered sufficient to be examiners. Our appeal, which the NMC has not responded to, is now pending with the @MoHFW_INDIA as a second appeal.
In the meantime, NMC is requested to alter the FAQ dated September 13, 2023, or to publish a new public notice on the Appointment of Examiners so that the position is clear to all.
Teachers with medical MSc/PhD qualifications working in medical colleges are the ones most affected by various forms of discrimination imposed by the regulator - the NMC.
With relentless discrimination, one can only wonder when this academic apartheid will end. How far can 'pride and prejudice' be the guiding principles for policy-making?
We urge @MoHFW_INDIA to form a separate council for us. Why are we being forced to approach courts for what can be granted by the ministry? Where is the 'antyoday' in practice that this government boasts about? Where is natural justice? How can a group of prejudiced professionals dictate policies?

Cases often accumulate and linger for years, even decades, without resolution, causing continued suffering for the public due to a dysfunctional judiciary.
It is essential for the government to take action in reforming the judicial system, ensuring that people can access justice within a reasonable timeframe.
If the government is sensitive and empathetic to the concerns of the public, it can prevent people from having to approach the courts. The government should act promptly and decisively to address issues.

The almighty NMC doesn't want any MBBS seat to remain vacant, hence the stray round despite the expiry of the deadline to admit students.
This same almighty doesn't want PG seats in non-clinical specialties to remain vacant, hence the reduction of the NEET-PG qualifying percentile to zero.
However, the almighty NMC isn't concerned about vacant faculty positions in medical colleges. To exacerbate the deficiency, they are promoting more vacancies by eliminating MSc/PhD teachers, which cannot be filled anytime soon.
Vacant MBBS seats are unacceptable, but vacant faculty positions are acceptable. If this is not hypocrisy, what else is it?
