There is something the Controller of Budget, CPA Margaret Nyakang’o said that we cannot just let slide!!

It is about the Consolidated Fund..the Government’s main public fund and her statement that her office has no visibility, yaani no oversight, over billions of shillings held in some funds and levies outside the Consolidated Fund.

Let’s start with the Constitution.

Article 206(1) clearly states that all money raised or received by or on behalf of the National Government should be paid into the Consolidated Fund, except where the Constitution or an Act of Parliament provides otherwise.

But the same Article allows money to be placed in other public funds established for specific purposes.

AND THIS IS WHERE THERE IS A BIG PROBLEM !!

Because according to the Controller of Budget, there are billions collected through various government funds and levies which her office does not have visibility on how the money is spent.

She specifically said “no visibility at all” regarding some of these funds and levies outside the Consolidated Fund.

Please, don't make the mistake of thinking we are talking about small money.

WE ARE TALKING ABOUT BILLIONS OF SHILLINGS COLLECTED FROM KENYANS.

Now, I have some very simple questions.

If these funds are outside the Consolidated Fund:
Who oversees the withdrawals?
Who authorises the expenditure?
Who accounts for the money?
Who prepares the financial reports?
Who scrutinises those reports?
Who independently audits them?

And most importantly:

WHO FOLLOWS THE MONEY FROM THE MOMENT IT IS COLLECTED UNTIL THE MOMENT IT IS SPENT?

Because Article 206(3) is also clear: money cannot be withdrawn from a national public fund outside the Consolidated Fund unless that withdrawal is authorised by an Act of Parliament.

So when the person constitutionally charged with this oversight tells us that her office cannot trace how billions collected through some funds and levies are being spent, that should concern every Kenyan.

I believe CPA Nyakang’o is raising an alarm, and I believe we must listen.

It is about accountability.

We cannot have billions of shillings collected from Kenyans and then have gaps in visibility over where that money goes.

As Kenyans, WE DEMAND TO KNOW:

Where was the money collected?
Where was it deposited?
Who controlled it?
Who authorised the withdrawals?
What was it spent on?
Who received it?
What reports were prepared?
And what independent audit was done?

Because public money is not anybody’s private money.

IT IS THE PEOPLE’S MONEY.

And every shilling collected from Kenyans must have a clear, verifiable and accountable trail.
