Don't confuse people, please. Section 8 of the Representation of the People Act (RPA) talks about the immediate disqualification of "any" convicted elected person. The newly proposed amendment does not apply to all elected persons, but only to ministers, chief ministers, and prime minister. Besides, this does not disqualify their status as a people's representative. It only removes them from the post of a minister, chief minister or prime minister. They will continue to be an MP or an MLA as applicable. Upon release from custody, they can assume the roles of a minister, chief minister, or prime minister as the case maybe.
