#SaraOnTrial: House prosecutor Rep. Chel Diokno on Saturday, July 25, issued a statement addressing a Facebook video posted by Sen. Pia Cayetano, saying he wanted to provide the "context" and his complete remarks from the exchange during Vice President Sara Duterte's impeachment trial.

Diokno disputed the characterization of the prosecution's subpoena request as a "fishing expedition," saying such a description would apply only if they were merely hoping to find evidence.

"Linawin ko po: Hindi tayo nagbabakasakali lang," he said, adding that the prosecution's request was based on Anti-Money Laundering Council (AMLC) records that allegedly showed billions of pesos passing through the accounts of Duterte and her husband.

He said the prosecution sought the bank records to determine whether they were consistent with the AMLC findings, stressing that such records could only be obtained through a court-issued subpoena.

"Ngayong may subpoena na para sa bank records ng Bise Presidente, magagamit ito ng magkabilang panig para patunayan ang kanilang kaso," Diokno said, adding that the evidence would allow the senator-judges to decide the case based on the full record.

Linawin ko po: Hindi tayo nagbabakasakali lang. May probable cause o sapat na dahilan na nakita sa mga record ng Anti-Money Laundering Council (AMLC) tungkol sa bilyun-bilyong dumaan sa accounts ng VP at kanyang asawa.

Hiningi natin ang bank records para makita kung tugma ito sa sinasabi ng AMLC reports. Tandaan: Ang bank records ay maaari lang mailabas kapag may utos o subpoena mula sa korte. Ibig sabihin, kung nabuksan ng Kamara ang mismong bank records bago ang trial, paglabag yan sa karapatan at due process ni VP Sara Duterte.

Ngayong may subpoena na para sa bank records ng Bise Presidente, magagamit ito ng magkabilang panig para patunayan ang kanilang kaso.

Sa ganitong paraan, makakapagpasya ang mga Senator-Judges batay sa kabuuan ng ebidensya.
