Their arguments in court today against the Expropriation Act stand out as clear and to the point. Simply, the constitutional text does not allow for zero-compensation takings. Nonstarter!
Their strong arguments through Adv Strydom SC support the @FMFSouthAfrica Rule of Law Project and @afriforum contributions to the case.
They haven't gotten much recognition in the press. 👌💪💪

AfriForum’s court application to have certain sections of the Expropriation Act – which, among other things, enables expropriation without compensation – declared unconstitutional is being heard in the High Court in Cape Town starting Monday (3 August).
@afriforum has appointed a top-tier legal team ready to challenge the Expropriation Act in court.
Fighting expropriation without compensation is not only in the interest of landowners; it is in the interest of everyone in the country. The example of Zimbabwe clearly demonstrates the destructive impact that the disregard for property rights has on a country and its entire population. The only people who stand to benefit from this legislation are a small political elite. Meanwhile, the poor – falsely portrayed as the intended beneficiaries – will be hit hard by unemployment, hyperinflation, and rising poverty. The millions of Zimbabweans fleeing to South Africa due to poverty serve as proof of the devastating consequences that disregarding property rights has for everyone.

AfriForum pak Onteieningswet vanaf Maandag in die Kaapse Hooggeregshof
@afriforum se hofaansoek om sekere dele van die Onteieningswet, wat onder meer onteiening sonder vergoeding moontlik maak, ongrondwetlik te laat verklaar, word hierdie week in die Hooggeregshof in Kaapstad aangehoor.
AfriForum het ’n topregspan aangestel wat gereed is om die Onteieningswet met mening te beveg in die hof. Dit is nie net in belang van grondeienaars dat onteiening sonder vergoeding beveg moet word nie. Dit is in belang van almal in die land. Die Zimbabwe-voorbeeld wys baie duidelik watter vernietigende uitwerking die miskenning van eiendomsreg op’n land en al sy mense het. Die enigste mense wat voordeelsal trek uit dié wet is ’n klein groepie politieke elite. Intussen sal die armes – wat valslik voorgehou word as diegene wat bevoordeel sal word – ook hard getref word deur werkloosheid, hiperinflasie en groeiende armoede. Die miljoene Zimbabwiërs wat weens armoede uit Zimbabwe na Suid-Afrika vlug, is ’n bewys van watter vernietigende uitwerking die miskenning van eiendomsreg op almal het.
Die toepassing van die Onteieningswet in sy huidige formaat sal wydlopende implikasies hê. ’n Voorbeeld daarvan is dat ’n grondeienaar se grond sonder vergoeding onteien kan word voordat ’n hof die geldigheid van die onteiening en die onteieningsbedrag bepaal het. ’n Grondeienaar – wat dan rééds sy grond en inkomstebronverloor het – sal derhalwe vir sowat vyf jaar lank op eie koste in die howe moet veg om die onteiening te betwis omdat dit jare vat om ’n bestrede saak voor die hof te kry.
Die meeste grondeienaars sal doodeenvoudig nie die fondse hê om betrokke te raak in ’n uitgerekte hofstryd teen die staat wat met belastingbetalers se geld litigeer nie.
AfriForum se argumente in die hof
AfriForum argumenteer dat artikel 12(3), 12(4) en 19(8) van die Onteieningswet geskrap en artikel 19(2) gewysig moet word omdat die genoemde artikels ongrondwetlik is.
Artikels 12(3) en 12(4) is volgens AfriForum daarop gemik om onteiening sonder vergoeding moontlik maak, ondanks die feit dat dit strydig is met artikel 25 van die Grondwet wat bepaal dat onteiening onderhewig is aan onder meer regverdige en billike vergoeding. Die ANC se pogings om die Grondwet te wysig het misluk. Daar word egter nou volgens AfriForum gepoog om die Grondwet op ’n onregmatige wyse te omseil deur ongrondwetlike wetgewing.
Artikel 12(3) van die wet lys ’n aantal voorbeelde van gevallevan onteiening waar geen vergoeding hoef te geld nie. Deur die gebruik van die woorde “insluitend, maar nie daartoe beperk nie” word dié lys egter oop gelaat met geen beperking op die gevalle waar onteiening toegepas kan word nie. AfriForum voer aan dat dit ongrondwetlik is. Die organisasie hou vol dat dié artikel selfs munisipaliteite sal toelaat om hul eie redes vir onteiening sonder vergoeding te versin en grond sonder vergoeding te onteien vóór die saak nog in die hof getoets kon word. AfriForum se standpunt is dat vergoeding altyd kragtens artikel 25 van die Grondwet bepaal moet word, met inagneming van die feite van die betrokke saak, hetsy deur ooreenkoms tussen die partye of deur die howe, en nie deur oop wetgewende kategorieë nie.
AfriForum se hofaansoek wys ook uit dat artikels 19(2) en 19(3) strydig is met artikel 25 van die Grondwet, omdat diéartikels dit moontlik maak om grond te onteien voordat ’n vergoedingsbedrag ooreengekom is of ’n hof daaroor beslishet. Die president én die speaker het volgens AfriForum in wese die ongrondwetlikheid van die artikels in hul hofstukke erken deur voor te stel dat ander bewoording in die artikels ingelees word. AfriForum vra dat hierdie artikels terugverwys word na die parlement vir behoorlike herformulering. Hangende daardie wysiging is AfriForum bereid om ’n tussentydse inleesbevel (reading-in order) te aanvaar, sodat vergoeding ooreengekom of deur ’n hof bepaal moet word voordat onteiening plaasvind.
