@smmarotta If the statutory maximum is 20 years, you have to engage in some real mental gymnastics to conclude that congress did not include the death penalty as a possible penalty because of Kennedy. There’s a pretty substantial sentencing gap between 20 years and death.
Daniel Sanchez Estrada wasn’t accused of attempted murder or material support of terrorism after a protest turned catastrophically wrong outside an ICE detention center in Alvarado, Texas. The first opinion is in US v. Hemani, on the federal law banning drug users from possessing firearms. In an opinion from Gorsuch, the court holds that the prosecution of Ali Hemani under that law is inconsistent with the Second Amendment.

This is such an important issue for Floridians & I’m so glad that SCOTUS is taking it up. Most people don’t realize that Florida is one of a few states where you can go to trial on a life felony & have only six jurors decide your fate. Justice Gorsuch has criticized the practice.
