The Associated Press is suing me for using a photo of myself.
Not a stock image. Not a product shot.
A photo of me, pitching during my Major League Baseball career.
Let me explain how this works—so you or someone you know doesn’t get blindsided like I did.
I run a small sports training business in Little Rock, Arkansas.
After years of financial struggle from COVID shutdowns (especially brutal in Arkansas for gyms like mine), we were finally getting back on solid ground.
I hired someone to build a simple website to showcase who I am and the players I’ve helped.
That included a few images pulled from the internet.
Two of the three were photos of me from my playing days.
I didn’t think twice—because most people assume that if it’s a photo of you, and you’re not selling anything, it’s fine.
That’s where the Associated Press steps in.
Even though they’re a nonprofit, they don’t play nice.
They outsource their copyright enforcement to a firm called Higbee & Associates—a law firm that scours the internet for unlicensed images and threatens small business owners with lawsuits.
No warning. No cease and desist.
Just a demand letter threatening thousands in federal damages unless you “resolve” it on their website.
Here’s what I’ve learned:
•It doesn’t matter that the image is of you
•It doesn’t matter that you didn’t profit from it
•It doesn’t matter that you didn’t know it was copyrighted
•It doesn’t even matter that you took it down immediately
They want money.
And they target small, vulnerable businesses that don’t have legal departments or the resources to fight back.
I’m a father. A coach. A former pro athlete trying to give back to the next generation.
Now I’m being threatened with a $5,000 bill—for posting pictures next to my bio on the Proformance website.
So I’m sharing it louder.
If you’re a small business owner, trainer, speaker, or anyone building a website—do NOT assume that an image is free just because it’s online or of yourself.
These companies will come after you—fast and hard.
And if you’re wondering what kind of “journalism” the Associated Press is supporting with the money from these threats…
