Yes, but their goal was land return (Aboriginal Title). Now they are permanently blocked from reclaiming private property and forced to settle for a backup plan: a taxpayer-funded cash payout. Losing the land and getting a consolation prize instead is the definition of a setback.

Yes it is. They designed their lawsuit to include private land. The courts permanently blocked that path. Had they won, it would have given them immense leverage in negotiations with the province and massive industrial players like J.D. Irving. That leverage is now gone. Etc.
