@JoshuaADouglas @StumboForAG Unless we want to say a clerk is counseling the Judge on the Judge's rights, duties, obligations, liabilities or business relationships... Then a clerk cannot be providing legal services to the Judge.
I wonder if federal clerks are required to carry legal malpractice insurance?

It can't fall under "counsel" because of the further qualification that it must be in respect to the "rights, duties, obligations, liabilities or business relationships of the one requiring services."
@JoshuaADouglas @StumboForAG This is an interesting line. Because the Kentucky Supreme Court has defined the practice of law... and to be honest I don't believe clerking fits the definition?
@JoshuaADouglas@BGPolitics The interesting distinction is for Judges, the language is "licensed to practice law." Language changes for prosecutors. To me, this would indicate that at least someone thought there is a difference b/w "licensed to practice law" (judges) and "practicing law" (prosecutors).
@JasonRileyWDRB There are some jails in KY with a phone number lawyers are to call to get your # on the "Do Not Record" list. The number we are told to call is often out of service/disconnected.
We end up traveling hours to talk face-to-face just to avoid being recorded.
