This question was answered by the Supreme Court in Veterans Federation v. Comelec (G.R. No. 136781) and clarified in BANAT v. COMELEC (G.R. No. 179295).

Step 1: Determine the number of available party list seats. The Constitution says it should be 20% of the House of Representatives. In 2025, there are 63 available seats.

Step 2: Calculate the percentage vote of the partylist (partylist votes / total votes cast), then rank them in descending order. [Meron na nito sa mga election results online.]

Step 3: All those which have at least 2% of the vote automatically get at least 1 seat. Subtract the number of already allocated seats from the total. (63 - allocated seats = remaining seats) [e.g. Right now [1:55am 13 May 2025], the top 6 party lists have at least 2%, so 57 remaining seats nalang.]

Step 4: Multiply the number of remaining seats by the percentage vote of the party list to determine how many additional seats it can get, with a max of 3 total seats for a party list. For this step, a party list need not get at least 2% vote to get a seat. [e.g. Akbayan currently has 6.6%. 57 x 6.6% = 3.762. But it can only have 2 additional already. So, 55 remaining seats nalang for the next ranking partylist. Do the same computation to the next ranking partylist.]

Step 5: Repeat Step 4 until maubos lahat ng available seats. It may reach a point when the formula yields a result less than 1. If there are still remaining seats at that point, just continue allocating the seats down the line hanggang maubos. Parang NBA draft.

#TanongNgBayan is almost a useless senatorial debate. We get to hear the political stand of senatoriables na halos wala namang chance manalo. The most impactful point of the show is to prove na yung mga mananalong senador ay takot sumagot at humarap sa tao about political issues.
