🚨 THE TRUTH ABOUT HOW WORCESTERSHIRE COUNTY COUNCIL DESTROYED OUR SON’S FUTURE 🚨
After 14 years of fighting Worcestershire County Council (WCC) and the Integrated Care Board (ICB), we finally secured an Education, Health and Care Plan (EHCP) for our autistic, disabled son, Robert Jnr. But after just 24 months, WCC ceased it. On 9 August 2025, the Special Educational Needs and Disability Tribunal struck out our appeal, stripping Robert of his legal right to support—not because we were wrong, but because the system is rigged to protect itself.
🔴 What This Really Means
Without an EHCP:
• Robert will have no guaranteed special educational provision, despite his clear and ongoing needs.
• WCC will wash its hands of him, ending any duty to fund or deliver essential support.
• Promises made under the Children and Families Act 2014 have been discarded by people who prioritize budgets and reputations over disabled young people’s lives.
🔴 The People Responsible
These individuals hid behind titles and failed Robert:
• Tina Russell, Chief Executive of Worcestershire Children First: Oversaw systemic SEND failings, protected staff, and avoided accountability.
• Melanie Barnett, Senior SEND Officer: Advised Robert to undergo an Educational Psychology assessment that identified extensive provision needs. Not a single recommendation was implemented. Said “it’s not personal, it’s business”.
• Daniela Carson, Council Officer: Deeply involved in mishandling Robert’s case, repeatedly ignoring statutory duties.
• Kyle Daisley, Governance/Safeguarding Leader: Signed off on unlawful processes and failed investigations. Daisley, former chairman of Worcestershire County Council, was found guilty of gross misconduct in June 2024 by a Warwickshire Police panel for posing as a woman on social media to obtain sexually explicit images from 52 men, behavior identified as predatory and for sexual gratification, breaching standards of honesty, integrity, and conduct. He would have been dismissed had he not resigned as a special constable.
• Maria Hardy, Head of the ICB: Ultimately responsible for health provision. Under her watch, Robert received zero CAMHS support since his 2015 autism diagnosis, despite clear recommendations from multiple specialists.
🔴 The Evidence They Ignored
• 2015 Autism Diagnosis: Came with clear clinical recommendations for support—never implemented.
• No CAMHS Support: Robert has not been seen by CAMHS. No therapy. No mental health support in 10 years.
• Educational Psychology Report: Funded by WCC, it listed targeted interventions, specialist therapies, and long-term provisions for education and wellbeing—none were delivered, breaching Section 42 of the Children and Families Act 2014.
• Inadequate Funding: Robert’s “personal budget” was set at £1,800/year (~£5/day), a fraction of the real cost of his needs (~£14/day for basic provision).
• Private Funding by Family: For years, we’ve privately funded his therapies—hydrotherapy, physiotherapy, and other specialist interventions.
• 14-Year Battle, 24-Month Plan: It took 14 years of relentless fighting to secure Robert’s EHCP, only for WCC to cease it after just 24 months, dismissing a decade-plus struggle without justification.
Statement from Malvern Hills District Council, which has also been stripped of its powers to decide on major planning applications by the Government. Nine councils across England have been censured this way - two of those happen to be in Worcestershire (the other being Wychavon).
