J: did you argue your "clear statement" with the DC Circuit? I think this argument is forfeited because you didn't raise it in the lower courts. You asked for immunity. Sauer: they're closely related. J: that's totally circular. You used the argument to AVOID constitutional question here. One more question: what is the argument that POTUS, who is bound by the law, is not on notice that he has to to his job consistent with the law. So why does congress have to say in every law "and the president is included." Is that what they have to do when writing laws?
