But in the EVM case the same court is refusing to rule that a citizen has the right to know as to whom he/she has voted and whether it has been counted!! इलाहाबाद हाई कोर्ट का फ़ैसला आया है कि उत्तर प्रदेश मदरसा एक्ट-2004 ग़ैर-संवैधानिक है, मदरसों में पढ़ रहे बच्चों को सरकारी स्कूलों में मुन्तक़िल किया जाए। इस फ़ैसले का असर 26 लाख बच्चों और दस हज़ार टीचर्स पर होगा।

संविधान के धारा 29 और 30 भार��� के हर अक़लियत तबक़ात को अपने तालीमी इदारे चलाने का हक़ देते हैं। इस लिहाज़ से यह समझना थोड़ा मुश्किल है कि कोर्ट ने क्यों कहा कि मदरसा एक्ट संविधान के ख़िलाफ़ है।

@myogiadityanath को ये साफ़ बताना होगा कि क्या वो इस फ़ैसले पर अपील करेंगे? उनकी सरकार ने बार-बार मदरसों को निशाना बनाया है। मदरसों में ग़ैर-मज़हबी तालीम देने वाले टीचरों की तनख़्वाह कई सालों से रुकी हुई है।

सर्वे और SIT के ज़रिए सरकार उन मदरसों को बंद करना चाहती है जो धारा 30 के तहत चल रहे हैं, सरकार से फंड नहीं लेते हैं। जो Madrasa Modernisation Scheme के तहत चल रहे हैं उन्हें शायद इस फ़ैसले के बहाने बंद न कर दिया जाए।

जब सर्वे शुरू हुआ था, मैंने उसे छोटा NRC बताया था तब कई "दिग्गज" मुस्लिम तंज़ीमों ने मेरा मज़ाक़ उड़ाया था और सर्वे का सहयोग किया था।

ये मदारिस मुसलमानों के मिल्ली इदारे हैं, इन्हीं मदरसों से हमारे बुज़ुर्गों ने ब्रिटिश सरकार के ख़िलाफ़ जिहाद का फ़तवा दिया था, इन्हीं मदरसों से हमारी कई पीढ़ियों ने इस्लाम सीखा है।

मदारिस हमें फ़साद और जिहाद का फ़र्क़, हक़ और बातिल की पहचान, जीने का सलीक़ा, इंसाफ़ का तक़ाज़ा सिखाते हैं।

हमारी क़ानूनी टीम हाई कोर्ट के फ़ैसले का गहराई से मुतालआ कर रही है, अगर ज़रुरत पड़ी तो हम हर क़ानूनी कार्रवाई का हिस्सा बनेंगे। इंशा'अल्लाह
