RBI proposes rules to let lenders disable phones for loan defaults @EconomicTimes

@AimraIndia India welcomes the @RBI guidelines on loan collection for smartphone sales. This will enable NBFCs and Banks to fearlessly offer loans through mainline mobile retail stores. We must extend our heartfelt gratitude to @CAITIndia and @ICEA_India for their constant guidance and unwavering support in pursuing this matter.

Here are some of the key points from the RBI guidelines for the awareness of our retailers:

1. Disabling Mobile Functions upon Loan Default

New Rule: If a customer purchases a mobile phone on finance (loan) and defaults on their EMI or loan payment, lending companies (Lenders) will have the authority to remotely block or disable certain features/functions of that mobile device.

Financed Devices Only: This restriction can strictly be applied only to the specific mobile device that was purchased using that particular loan.

Implementation Date: This rule is proposed to come into effect from October 2026.

2. Strict Regulatory Framework (Tight Regulation)

Essential Services Protected: The RBI has clarified that these restrictions will be highly regulated. Companies cannot block essential services on the mobile phone, such as emergency calling or basic connectivity.

Graduated Approach: Instead of locking the phone immediately, a step-by-step graduated approach must be followed against loan defaulters—meaning prior warnings must be issued, followed by partial restrictions, before taking any strict action.

3. Stringent Rules for Recovery Agents and Data Privacy

The RBI's mandate extends beyond phone locking, introducing comprehensive Recovery Conduct Rules to reform the entire recovery ecosystem:

Agent Certification: It will be mandatory for loan recovery agents to be certified. This step is being taken to prevent arbitrary conduct and harassment by agents.

Data Privacy Mandate: Companies must strictly protect customers' personal data. No violation of a customer's privacy will be permitted under the guise of loan recovery.
