@jjellisart according to the court, the deciding factor is the more the perspektive, image composition, fov, lightning etc are exact copies of the other, the more risk there is of it being a copyright violation. having the same motive of a dog and a red ball is not a copyright violation.

It is like Sega patenting the arrow for navigation.
