@alistair_sloan See our other response . We appear to be the only part of the profession that has tried to change this, even though we are very small with limited resources.
@alistair_sloan Agreed, but the crown would have applied Scot’s law before deciding to prosecute. The reliance on reporting agencies might be worthy of consideration.
@RoddyQC@BillAlexander4@broon313@Lawscot@JudgesScotland No problem, you just need to qualify as an architect, engineer, or surveyor, and practice in construction for 10 years as well as being legally qualified. We might let you skip the advocacy training though 😉
The Legal Aid fee for conducting a trial at the Justice of the Peace Court is £54.08. That is the daily fee, not the hourly rate. It’s simply not possible to sustain a business when the fees are that low. Good luck to our justice partners having to deal with all the self-reps.
Lord Hope’s point is a crucial one. @FacultyScot, @Lawscot and @ScotAttorneys need to be consulted on these plans, given their implications. Absent consultation, how does UKGov know that this can or will work in practice?
@EdinBarAssoc@ScotGovJustice Access to justice is a fundamental human right. For there to be equality of arms in court proceedings, defence lawyers have to be paid a reasonable rate.
