@IJSanders Also riffing, and with significantly less expertise than you, I would assume that most of those changed details are statutorily created, no? I know Michigan has extensive statutory frameworks for trusts and estates. In any event, looking forward to learning more next month!
@IJSanders At the risk of pestering/asking you to work on a weekend, can you give me an example of how courts’ equity powers evolved (outside of universal injunctions, again) except in cases of new, statutorily granted powers? I just find this point intriguing.
@IJSanders Outside of the context of universal injunctions, has the general understanding of a court’s equitable authority changed dramatically since the judiciary act? The common law seems inherently based upon evolution through judicial construction but I’m not aware that’s true of equity
