🇺🇸 FORMAL APPEAL REGARDING IRAN’S FORMER CONSULAR PROPERTIES IN CHICAGO

We respectfully request that the President of the United States initiate a formal review of the future status of Iran’s former consular properties in Chicago in connection with any future restoration or restructuring of diplomatic and consular relations between the United States and Iran.

The United States severed diplomatic and consular relations with Iran on April 7, 1980. Federal court records establish that two condominium units owned by the Government of Iran at 155 N. Harbor Drive, Chicago, Illinois, had been used as residences for employees of the Consulate of Iran before the severance of relations. The properties subsequently came under the custody of the United States Government.

Under the U.S. constitutional system, the power formally to recognize a foreign government belongs to the President. The Supreme Court confirmed the President’s exclusive recognition power in Zivotofsky v. Kerry.

Mr. President, @POTUS, we respectfully request a formal determination of the diplomatic and legal framework that would apply if, during a democratic transition in Iran, the United States recognizes a competent Iranian transitional authority, including any authority led by Crown Prince Reza Pahlavi, @PahlaviReza , as authorized to represent Iran in relations with the United States.

Secretary Rubio, @SecRubio, if such recognition occurs and direct diplomatic or consular relations are restored, we respectfully request that the Department of State undertake the necessary diplomatic and legal procedures for relations with the recognized Iranian authority, the acceptance of its duly appointed representatives, and a determination of the lawful future status and use of Iran’s former diplomatic and consular properties in the United States.

We further request that the Office of the Chief of Protocol carry out the applicable procedures for the acceptance and accreditation of representatives duly appointed by any recognized Iranian authority, including the agrément and credentials process where applicable.

We also request that the Department of State, through the Office of Foreign Missions, determine the present legal and custodial status of the two former Iranian consular residential properties at 155 N. Harbor Drive, Chicago, and identify the lawful arrangements that would govern any future diplomatic or consular use of those properties.

Under 22 U.S.C. §4305(c), when a foreign mission has ceased its diplomatic or consular activities and no approved protecting power or agent has assumed responsibility for its property, the Secretary of State may protect and preserve that property.

State Department records have also described the Office of Foreign Missions as the custodian of 11 Iranian diplomatic and consular properties in the United States following the severance of relations.

Any existing protecting-power or custodial arrangements should then be reviewed as appropriate in connection with any restoration of direct diplomatic or consular relations.

This request concerns the future diplomatic representation of Iran during a democratic transition and the lawful status and future use of Iran’s former consular properties in Chicago.
