DOJ indicted an Olympian for felony vandalism of the Lincoln Memorial Reflecting Pool.

Then prosecutors obtained the government’s own construction records.

Those records showed something rather inconvenient:

The damage existed before David Hearn touched the pool.

DOJ concluded flawed installation, not vandalism, caused the damage and dropped the case.

Now Hearn’s lawyers say evidence of those construction problems was available before the indictment.

That is the real story.

The government accused a man of causing damage before prosecutors had obtained the government records showing what actually caused it.

The question is no longer whether Hearn damaged the pool.

It’s why DOJ asked a grand jury to indict him before checking the government’s own evidence.
