On Aug. 10, 2026 a federal court issued a preliminary injunction and froze work at Colosseum pending the merits. That is exactly why Congress should speak clearly. The 1994 California Desert Protection Act preserved valid existing rights. On the Senate floor, Sen. Feinstein said: “All existing mines are protected. All valid existing mining claims are protected.” Colosseum already had a BLM-approved 1985 Plan of Operations. Congress does not need a 400-page bill. One paragraph can settle it: “Nothing in the California Desert Protection Act shall be construed to terminate or require new NPS approval of a Plan of Operations approved by BLM prior to October 31, 1994, or to prevent exploration and production of critical minerals, including rare earth elements, consistent with that Plan.” Colosseum sits about 6–7 miles (10 km) from Mountain Pass, the only operating U.S. rare earth mine. Anyone can hack into the flock system. It’s not that difficult. It’s on YouTube.

These Flock systems aren’t just cameras; they’re far more insidious. They have sensor packages collecting data from wireless sensors on your vehicle, the 4G or LTE modems that transmit telemetry to car manufacturers (who sell it to insurance companies), and unique ID signals from your phone, smartwatch, earbuds, and other devices. They collect RF data and use radar modules (with no FCC ID that can be looked up). All of this feeds into Flock’s massive database, where AI links the collected information to create patterns and habits from your movements and activity.

These cameras are probably short-lived. Soon they won’t be needed, because data can be collected from locations that no longer have to be visible. It’ll look like a “win for privacy,” but we’d still be under a surveillance state where our data is sold for profit.

Flock is aiming for the world’s largest database, marketed as useful to law enforcement but really built for major manufacturers. There is huge value in connecting every person to devices and movements and building a lifelong pattern for each individual that can be tracked. It’s not really about stopping crime. It’s about a monopoly on data.

(also known as the Colosseum Mine Protection Act)A BILL To secure America’s domestic supply of critical minerals and gold, protect national security, create American jobs, and ensure the responsible, perpetual operation of the Colosseum Mine in San Bernardino County, California.SECTION 1. SHORT TITLE.
This Act may be cited as the “U.S. Resource Protection Act of 2026” or the “Colosseum Mine Protection Act of 2026.”SECTION 2. FINDINGS.
Congress finds that:
(1) America must never again be held hostage by foreign adversaries for the critical minerals that power our military, technology, energy systems, and economy.
(2) Rare earth elements and gold produced on American soil strengthen our national defense, reduce dangerous dependence on China and other foreign sources, and keep good-paying jobs right here at home.
(3) The Colosseum Mine holds proven gold resources and significant potential for rare earth elements, located just miles from America’s only operating rare earth mine.
(4) The United States has a proud tradition of responsible mining that built this Nation; modern operations can and must protect the environment through strict reclamation, wildlife safeguards, and best-available practices.
(5) Valid existing mining rights at Colosseum predate the creation of Mojave National Preserve and must be honored so that America can secure its own resources for generations to come.SECTION 3. PURPOSE.
The purpose of this Act is to ensure that the Colosseum Mine may explore for, drill, extract, process, and produce gold and rare earth elements in perpetuity under responsible environmental standards, free from undue legal or administrative obstruction, in the vital national interest of the United States.SECTION 4. AUTHORIZATION AND PROTECTION OF OPERATIONS.
(a) The Colosseum Mine is hereby designated a Critical National Resource Project of the highest priority.
(b) Notwithstanding any other provision of law, the valid existing rights of the operator to conduct mining, drilling, exploration, and related activities for gold and rare earth elements are affirmed and shall remain in full force and effect in perpetuity.
(c) Any preliminary injunction, temporary restraining order, or other judicial or administrative action that halts or restricts lawful operations at the Colosseum Mine is hereby superseded and shall have no further force or effect. Federal agencies shall take all necessary steps to restore full operational authority within 30 days of enactment.
(d) Operations shall continue under the existing approved Plan of Operations, as may be reasonably updated for modern safety and environmental performance. The Secretary of the Interior shall ensure ongoing compliance with reclamation requirements, protection of water quality, wildlife habitat (including desert bighorn sheep), rare plants, and public access where compatible with safe mining.
(e) No additional permits, environmental reviews, or approvals beyond those already in place or required for ordinary safety and reclamation shall be imposed that unreasonably delay or prevent production.SECTION 5. ENVIRONMENTAL STEWARDSHIP.
Mining under this Act shall be conducted with full commitment to protecting America’s natural heritage. The operator shall maintain active reclamation, dust control, erosion prevention, and habitat restoration throughout the life of the mine and after closure, ensuring the land is left better for future generations while delivering the minerals America needs today.SECTION 6. EFFECTIVE DATE.
