@taxleonard Actually, all 7 judges sided with the taxpayers ultimately - it was 4:3 that the payments did not include a royalty but unanimous that no income had been derived by the taxpayers, so no tax was payable by them whether there was a royalty or not.
@tobyeggleston@John_Poelwyk@jason_king72@TaxPawspective Yep I think they’ll be looking at legislative fixes, though ultimately these payments were not mischaracterised royalties so that measure itself would seem not to help (and the treaties may also be an impediment, not to mention the Trump factor).
@jason_king72@John_Poelwyk@tobyeggleston@TaxPawspective I would suggest it’s actually a 7:0 loss for the ATO - a minority held there was a royalty but no income derived by the taxpayers so no RWT payable by them. The FCAFC had held the same so essentially the ATO ended up losing 10:1.
@tobyeggleston Most unclear. I don’t understand why the PC would propose a new tax regime rather than, say, full expensing for income tax. I’m also unclear why it would be called a cashflow tax when it ignores interest outflows.
